'We Must Expand the Court:' Sen. Markey, Advocates Call for Adding 4 SCOTUS Seats


Massachusetts Sen. Edward Markey is renewing his push to expand the U.S. Supreme Court by adding four seats, less than a day after President Biden announced his support for reforming the high court.

Speaking in front of the Court building Thursday, the Democratic senator urged Congress to pass the Judiciary Act, a proposal that would create a 13-justice bench. He was joined by Rep. Hank Johnson (D-Ga.) and advocates for court reform.

“The illegitimate and ethically challenged far-right majority has fully captured our highest court and plunged it into a crisis of confidence and legitimacy. We must expand the court,” Markey said at the press conference.

I'd be ok with every President nominating 2 per term until the number stabilizes at whatever.

It would be a nightmare if it happens when there is a Republican in office. All we need is 4 more young Clarence Thomas’s on the court.

Adding 4 instead of 6. Has going from 6-3 in favor terrible decisions. To just 7-6 in correct decisions. Maybe! We need a bigger cushion
then that.

We would be accused of trying to pack the courts and the Republicans would return the favor in kind the next time they get the presidency and senate.

However we could possibly justify adding 2 judges to make up for the imbalance caused by McConnal stealing Obama’s pick in 2016 (claiming it was too close to the election) and then rushing to replace Ginsburg when she died even closer to the election date.

We could even say we are returning the court to where it should have been when Biden took office and since there would be a 1 seat Republican majority they couldn’t accuse us of packing the courts.

All we would have to do then is wait for a single RW judge to leave the bench to get a liberal majority. Given that the two oldest justices are Republican we wouldn’t have to wait long.

That said, this is all contingent on us getting both the Presidency and the Senate (with a filibuster proof majority) which is a pretty tall order to start with.

There are thirteen circuits now. During Roosevelt's term, there were only ten so his "court-packing" was harder to justify. Thirteen just makes sense now so that some justices won't have to administer multiple circuits.

... the implementation of an expanded court will be challenged in court, then appealed up to the Extreme Court, who will slow-walk any decisions until after the next inauguration. So, if we have a Repug president, or a Repug senate, no liberal judges will get a seat.

It's worth trying though, because if we get Prez Trump and a Repug senate, they will certainly expand the court and add some more Clarence Thomases.

It can't pass the current House or Senate

This plan can only work if Harris wins and brings significant majorities in both chambers (which is unlikely in the Senate). All it serves as this point is as a rallying cry for the election - and a possible embarrassment if we lose.
