We have received word from the family of The Magistrate that he has had a sudden and devastating heart attack. I've been asked to post the following on behalf of his family:
This week, days after seeing his cardiologist (who gave him a clean bill of health), The Magistrate had a severe heart attack that doctors say would result in permanent brain damage. He is totally unresponsive and will not survive. Tomorrow doctors will remove him from the respirator. Our extended family will be there along with friends.
DUers have been so generous in the past with their tributes and best wishes that the family would love to read the replies at the funeral. Please post your condolences and memories of James, aka Papa, aka The Magistrate, a kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him. We will miss him forever.
The Magistrate has been a fixture on Democratic Underground for nearly 23 years, almost since the beginning. He joined in October of 2001, less than a year after the site was founded, and his sardonic wit and playful, unique posting style quickly made him a favorite of many DUers -- and occasionally drew the ire of others.
But as much as he sometimes raised the hackles of the folks with whom he loved to verbally joust -- and he wouldn't have had it any other way -- nobody could ever claim that The Magistrate did not care about this country and its future.
Sir, you were a great Democrat, and a great DUer, and you will be greatly missed.

Whenever I saw one of his posts, I read it very eagerly, knowing what he wrote was going to be both brilliant and accurate, as well as witty. Every post he made, always made me think more deeply about the issues, and informed me.
I was sad to learn of his passing. I will miss his wisdom.

I want his family and friends to understand how much we all love his presence here and he'll be leaving a hole that can't be filled.

This is what terrifies me about going to my cardiologist. My mother had a stress test, and then got a clean bill of health the day before she dropped dead of a heart attack in front of me. It happens more than people realize. A good reason to always tell your people you love them.

(30,622 posts)I hadn't heard from her for awhile. Was wondering if she unfriended me. So, I went to her page, "We miss you". She died suddenly and had posted several times on the day she died. I don't know how she died, but I assume it was a sudden heart attack or something similar.

(120,673 posts)That Friday, she flew back to Detroit to oversee settling her mother in the nursing home they had chosen. She woke up the next morning, told her son, with whom she was staying while everything was settled, that she wasn't feeling well. Twenty minutes later, she was dead from a massive coronary. She was slender, non-smoker, casual drinker, upbeat, grrat sense of humour. No indications or markers at all.

(8,881 posts)The Magistrate and I did not always agree on the remedy for the 1/6 insurrectionists. I was much more emotional than he. He lived up to his name, the Magistrate. He was reasoned and logical like good judge would be. He helped to ground me and keep me on the strait and narrow. I will miss his honest and direct assessment. (106,778 posts)I feel especially devastated that there were no obvious signs that might have forewarned his cardiologist, and somehow led to the prevention of this horrible outcome. That only makes the news more heart-wrenching--even while I know it happens-- no matter how good the care.
As a fellow member here from the beginning with The Magistrate, I can echo those who reference his intelligence, eloquence, broad understanding of issues, and curiosity for those he was learning anew. His posts could always be identified immediately by his preferred use of "sir" in each and every one. I shall remember him fondly for a lot of things, but always with that mandatory emblem of respect.
DU will never be the same without you, but you, sir, will be remembered. RIP

Thank you for being one of the first to welcome me to DU 20 years ago. Thank you for helping navigate this place early on and providing some wonderful guffaws. I appreciate your style, wit, and compassion. I also appreciate the way you stood up for and spoke out on behalf of the Jewish community, in ways, many here, don't even know.
I wish you could have seen out first female president ascend to the White House, but maybe you still will. Who knows.

(26,466 posts)I worked closely with The Magistrate when I joined him in moderating the Israeli/Palestinian Forum at Jack Rabbit's retirement. The I/P forum at the time was unlike any other forum and prone to intense and personal flame wars between the various members. The topics and nuances of the situation required not only expertise but also the patience of Job. James was all of that and more. He was always fair, and no matter how heated the thread was, even if it was personally directed, he maintained a high standard and a sense of decorum.
Like me, he was a long-time student of military history and was very familiar with the many conflicts in the world over time. His passion for aircraft modeling was well-regarded by those in the hobby industry. We had many wonderful conversations about history and living in the 1970s. We talked about our personal lives and grew as friends. He always was a gentleman and a scholar. I am sad I never had the opportunity to meet him in person.
He and I used to quote an old military expression from the Philippine-American wars around 1900 about officers who served on the island of Samar during the fiercest of the campaigns. The allusion refers to the I/P forum.
Please stand for my friend James, "He served on Samar." Pass the bottle saved as a tontine and drink slowly and deeply to a gentleman, scholar, and true bohemian in life. May his memory serve as a blessing.

In every single post, interaction and discussion with The Magistrate, including a few where we might have disagreed on a subject, was an enlightening experience.

I was introduced to the reading of one of my very favorite authors, Saki (H. H. Munro) by The Magistrate. Which has become a cherished source of my inspiration ever since.

He was there for me on many occasions. The Magistrate saw things the way they were rather than how he wished they would be. His loss will be felt deeply by many who considered him a friend. I will miss him deeply.
In real life, it must have been a joy to know him.

When I replied to him as Sir, I always wished for a little emoji that was making a formal hands-in-sleeves bow.
The Magistrate lost a lot of his lightness when his son passed away, but was still our sage with the formal air.
I weep as I write this, Oh Sir, please dont go yet. Yet if there is anything we learn as we age, its that we all must go in our time.

Please know that our hearts and love and sorrow go out to all of you in this grievous loss. The Magistrate, as we knew him, is a tremendous loss to all of us here on DU. I remember encountering his posts when I first came to DU, months before I actually joined. From the first, I delighted in his formal, wickedly smart, often brutally ascerbic and funny, comments. His posts, amoung others, let me know that I had truly found my home in DU, and that has not changed in almost 22 years.
Please know that, just as James is/was part of our DU family, so, too, are all of you. We are here for you.

The sigline he chose: "When things are not called by their right names, what is said cannot make sense. When what is said does not make sense, what is planned cannot succeed. When punishments do not fit crimes, people cannot know where to put hand or foot." revealed his commitment to clarity, quality of communication, and community-building.
He was one of the earliest posters I remember engaging with regularly, and I was always secretly quite chuffed when he posted an accolade in response to one of my posts. His breadth of knowledge and the depth of thought and analysis he brought to many discussions truly enriched the quality of interaction here.
I am not surprised to learn his real-world family and community knew him as a "kind, caring, funny, very very smart and loyal man who was considered very special by everyone who knew him". He was all that and more, here, and I will miss him greatly.

I always felt that he was someone who was willing to listen to my opinions -- which are not popular -- with an open mind and sometimes an open heart, which is all I can ask for online. And when I disagreed with him, I had only respect for him; never contempt. We also had a DM conversation that was one of the most gracious I have ever had on the internet with anyone. I am so, so sorry to hear this news and his family is in my thoughts.

(12,909 posts)The Magistrate (or James, as hes now been revealed to us) has been a DU stalwart for almost 23 years. Hes always been a part of my DU, since I joined the group three months after he. What a force he has been within this community!
His prose was impeccable, his passion and intellect formidable in equal measure, his sly sense of humor devious and occasionally devastating. He certainly kept us on our toes by setting a consistently high bar for those of us who strive to think and write as well as he did.
I would be lying if I said I always agreed with him and I know he would not want any of us to pretend otherwise but I can honestly say that his arguments were always bolstered with a deep knowledge of history and culture, thoughtfully reasoned, and quite artfully expressed. No one could accuse him of anything less than 100 percent loyalty to the Democratic Party and the profoundly human values it represents.
I had very few direct interactions with him, although I always read his posts, because I considered him one of the DU members whose ideas and opinions were consequential. As much as it pains me to admit it, he caused me to change my mind a few times, or at least to soften some of my perspectives.
I remember when The Magistrate reported that hed be away for a while after his son unexpectedly keeled over dead. The father of two myself, I have some sense of the anguish that such a loss brings although only the parent whos lost a beloved child can truly know that kind of grief. And now Jamess family has to find the strength to bear another unbearable loss.
I hope his family and friends will find some solace in knowing that he had much love and respect from this cantankerous community of unlikely allies, and his influence will long linger.

(177,008 posts)I was lucky to meet The Magistrate a few times. He was not what I expected, but the minute he walked into the restaurant we all knew it was him.
Though I never knew his educational level, The Magistrate has to be one of the most widely read people I've ever known. There was nothing that he could not -- or would not --discuss with great intelligence. I served with him as a moderator years ago. He was a big help to me in learning the ins and outs.
This is a lovely tribute to him. As you say, he was a great Democrat and a great DUer. I'll miss him.

If I'd ever been asked, "Which DUer would you most like to converse with in person?" it would surely have been The Magistrate.
Although I haven't been around DU much for the last 5-10 years, The Magistrate stays in my memories!

I am deeply sorrowed by this news. It will take some mulling over, some thoughtful consideration of his decades of words on this site, to come to terms with this news. But his impact on DU was enormous, and positive.

Im so sorry to hear this. The Magistrate has always been there to offer wisdom and perspective. We are all the poorer for losing him but all the richer for having his posts to read and ponder. He always made me feel like sitting up straight, with head held high and eyes and ears wide open, and hopefully, mind wide open, too.

The Magistrate definitely falls under the category of irreplaceable people, and I daresay it will be some time, maybe an eternity or two, before he is replaced.
Sly, erudite, eloquent, interminably patient, and courteous to a point bordering on chivalry. I have had the privilege of having one real life friend like that, and he suffered the ironic fate of being portrayed in a famous film as everything he was not. The Magistrate, at least in our tiny-yet-vast DU microcosm, will need suffer no such fate. The accolades for this irreplaceable (mes excuses, monsieur Premier Ministre) DU icon are deservedly universal.
I can only wave to a grand ship that has sailed for the last time. Shalom, salaam, sai jien, and above all, fair winds.

Whenever I saw The Magistrate's posts, I always stopped to listen and hear his thoughts, to soak in his lovely prose. He will be very sorely missed.

(20,855 posts)almost immediately became familiar with the Magistrate's posts and began to look for them whenever I logged on. He was a kind of DU map for me the first few months I was on here. He was often able to effectively communicate what many of us were thinking and feeling, but didn't always know how to put into words. He's such a foundational fixture here that it's hard to imagine DU without him.
His love and concern for the country, and his desire to keep working to help it live up to its founding principles, was always inspirational. Especially during more discouraging times when it seemed that nothing would ever change and we wondered what was the point in continued efforts and work.
I am so very, deeply sorry to hear of his passing and I hope it brings the family at least some comfort to know his positive impact here and how much he meant to all of us!

I had a couple beers with him quite a long while back. That's when I found out about his ticker.
I enjoyed that couple hours immensely.

It is through The Magistrate that I know James, for The Magistrate is his persona, the narrator of this particular story told through DU about the moral and ethical state that we, as a nation, have found ourselves in for the past twenty years.
So what exactly is a magistrate? A magistrate is an official who hears cases, delivers rulings, and issues warnings. Because the office is established to serve the best interest of the community at large, it is one of great responsibility.
When the job is done well, a magistrate earns respect and establishes trust, not so much through detached objectivity, but through his understanding of our common and connected humanity, informed by a considered perspective and a upright moral compass grounded in decency and compassion.
Jamess Magistrate is the best kind of magistrate, an exemplar of the better angels, a magistrate who speaks deep truth in a deliberate and measured voice with the certainty of the righteous.
I am always inwardly proud and somewhat relieved when I find myself on the same side of an issue as The Magistrate, such is the esteem and respect that I hold for the ethics of his perspective. I have always been mam and never the rare dreaded and devastating dear, a single word that cut so deep and clean that the recipient was left to wonder, Why am I bleeding?
I had my one and only personal contact with James the man only last week when I thought I might have offended him with a response that was made to him, simply because it was the safest place to put it. The topic involved a problematic four-word phrase in a long speech. It was a close readers concern, so I knew he would understand.
Jamess response was gentle and friendly. He pointed me in the direction of a Mark Twain essay that he said was the best and funniest writing advice that he had ever read. He thanked me for my kind words and exhorted me to be well and stay healthy.
I will not speak of The Magistrate in the past tense. That narrator, the persona of the author himself, will live on in the same way that characters live on in literature. And as for James, decent, kind, funny, and brilliantly gifted, I choose to leave the verb unspoken.
It has been an honor.

(7,334 posts)I remember The Magistrate from my very first day on DU way back in November 2004. I at first saw him as an ornery fellow...but then I learned that he was also a fierce dedicated warrior for the Democratic way of life.
I was at times both victim of his sharp wit and intelligence, and fan of his stout defense of Human Rights and of We The People.
Sir, WE THE PEOPLE are going to preserve Our Democracy this November 2024.
I know you will be watching from above, Sir. I am among legions who bless the good work you have done here on this Third Rock from The Sun.
I am going to work my ass off to make sure we defeat the forces of evil in November. Doing it in Your honor just sweetens the deal.

I am not surprised his final words here would be affirmative and supportive. I admired his passion and his sense of humor. My thoughts are with his family in their time of loss. He will be greatly missed.

He and I shared an interest in early aviation, though he was much more knowledgeable about the subject than I.

(1,049 posts)and after lurking a few days joined on Thursday so I never had the pleasure of reading any of The Magistrates posts.
As I read through each of the many tributes I couldnt help but regret I had never encountered this man myself. Before I finished reading I found I couldnt withhold tears of sorrow for someone so loved by his DU family. It speaks to the integrity of both The Magistrate and of the DU community.
Go swiftly on your journey to eternity, Sir. I cant help but think there are great things in store for you there.

(13,456 posts)I think I joined DU around the same time as The Magistrate--give or take a few days. The Magistrate was the first DU'er who caught my attention with that strong wit and his well-versed insight on issues that I was just learning about. He once corrected me on an issue that I was confused about and while he was very respectful and kind explaining this issue to me, I couldn't help but feel like I was sitting in the principals office. He had such a command of language and insight that I found myself looking to him for clarity on things as well as reassurance.
Those early days here at DU were wrought with fear, anger and sadness, because the Supreme Court had just handed the election to Bush. I can remember so much hand-wringing ( from most of us) and uncertainty at that time (who knew Bush would look good compared to you-know-who), but The Magistrate always seemed to know what to say to get a laugh out of us and calm our fears.
There's just not enough words to say all the things I want to say right now, so I'll just end with, "Sir, it was an honor to 'know' you here at DU and to fight in the trenches together."
RIP and know that you will be sorely missed.

Like Blue Roses, James was enraged over the 2000 election results. I said something like Why don't you find a site where you can say what you think? Here's one you might like.
I am not The Magistrate's wife. I'm a very lucky member of his extended family. He equally divided how much time he would spend with his wife or me, and everything was fair. We were together almost 30 years. He and Mary, who met in high school, were together 57 years. Lithos will be posting the obituary that will appear in tomorrow's Chicago Trib, and he might post some photos.
The word "brilliant" pops up in a lot of posts. I counted on his brilliance to help me understand stuff that long Covid has made hard to comprehend.
That's all I can say right now. He's all over my apartment and I cry in every room.

He was an incredibly intelligent man whose love for both country and humanity shone through his prose. His posts helped me maintain my sanity during some of America's darkest moments. My heartfelt condolences go out to his family.

Our shared disdain for Greenwald, our mutual respect for those who suffer under tyrants, and the understanding that sometimes, we must go to war.
Because The Only Thing Necessary for the Triumph of Evil is that Good Men Do Nothing.
Our shared understanding that inequity cannot be allowed to persist. That sometimes comprises must be made. That sometimes people must work from the middle. Our mutual disdain for the Soviet sphere and our shared knowledge of how desperately hopeless it was. Our disdain for modern Russia and their imperialist designs.
You were Good Man and poster here at DU for 23 years. You will be sorely missed, Sir. Thank You For Doing Something.
