NY Judge Refuses To Marry Lesbian Couple

The Syracuse Post-Standard reports:

A Syracuse City Court judge recently refused to perform a wedding ceremony for a same-sex couple. Judge Felicia Pitts Davis was the assigned judge for arraignments on Saturday, Nov. 16, and two weddings were scheduled, according to the members of the legal community familiar with what happened. Pitts Davis performed the first wedding — a heterosexual couple — but refused to officiate the second because it involved two women, according to the sources.

Another city court judge, Mary Anne Doherty, came into court to officiate the women’s marriage, the sources said. Davis told Doherty she didn’t want to conduct the ceremony to marry the same-sex couple because of her religious beliefs, the two sources said. Under state law, judges may not unlawfully discriminate by officiating a marriage for a male-female couple, but refuse to do the same for a same-sex couple, according to a state court spokesperson.

The lesbian couple says that the judge was “emotional and cried” while performing the straight marriage but did not even knowledge them when she left the courtroom.

Central New York Pride is demanding the judge’s resignation.

She needs to resign or at least be severly reprimanded. This is NOT acceptable behaviour in 2024!

You can’t do that, you need to find another job. Heritage Foundation may be hiring, but since the judge is a woman, they’ll hire her as council but treat her like a secretary. Hope she knows how to brew a good cup of coffee!

to set aside personal biases/beliefs to sit on a jury. Why can't judges set aside their biases and religious BS when it comes to marriage?

If a judge is unable to officiate a same-sex wedding, they should be equally unable to adjudicate anything involving LGBTQ plaintiffs or defendants.

Bias has no place on the bench. Period. Granting exceptions for it is the slipperiest of slippery slopes. Hard pass.

...there may be paperwork submitted into evidence that indicates a same-sex partner, for example. Or they may bring their partner with them to court.

You're right - it won't necessarily be apparent. But it can be.

And it's hard to know what the judge actually knows about you.

Marriage, for many people, is a religious thing. Many people feel the same way this judge does that marriage is a heterosexual thing from the bible and blah blah blah.

Being asked to decide an eviction case or contract dispute, does not necessarily involve a conflict of religious beliefs. Religious accommodations doesn't apply in all circumstances. A party of a case simply existing as LGBTQ does not raise a conflict.

For those circumstances, like officiating a same-sex marriage, I think a religious accommodation can apply unless there is literally no other judge available.

I talked about this some time ago with the example being my mother's hometown. My mom is from small rural town in Georgia. There is only one judge in the county. If that judge refuses, then what? My response to that is he wouldn't get a religious accommodation in that case, because he's the only judge. It is not possible to accommodate him.

They may feel that homosexuality itself is a great wrong, or that it's something that can somehow be "cured."

I don't know that this judge feels that way, but it's quite possible. And based on other comments, it would appear that the judge treated the couple very rudely in addition to not doing the marriage.

In any case, she discriminated against people based on their sexual orientation. If one's religious persuasion disallows same-sex marriages, one shouldn't be in a career that requires one to formalize them.

Same thing with pharmacists who refuse to fill certain prescriptions for religious reasons. I have no patience for that. Either agree to fill prescriptions, or find another line of work.

I'm not LGBTQ, but if I was, I'd do whatever I could to get any case I'm involved with heard by a different judge in that jurisdiction.

A transvestite might appear in court wearing clothes associated with the other sex.

A romantic partner might attend trial for a lesbian or gay person and be appropriately affectionate.

LGBTQ people have been able to live more openly as such for decades.

Refusal to marry a mixed race couple? Refusal to marry non-Christians or people whose religion differs from that of the judge? Refusal to marry previously divorced people (specifically forbidden by Jesus, according to the Bible)? Refusal to marry vegans? Refusal to marry anybody the judge decides is "against their religion?"

And where does it end? Just marriage, or hearing cases? Does a judge get to refuse to hear a case if "their religion" tells them to hate white people? (A tenet of the Nation of Islam, for instance.)

Or is it just gay people that this bias is reserved for?

...should be reviewed. She just opened the door to having many of her decisions overturned because of her flagrant bias.

How many cases has she ruled on based on her "religious beliefs" rather than the law? Someone like this has no business ever getting close to a judgeship. Beyond unacceptable.
