Chris Wray's Resignation Sets Up Legal Hurdle for Kash Patel's FBI Bid

By resigning, rather than waiting for Trump to fire him, Wray is setting up a legal obstacle to Patel's immediate installation as FBI director.

Author David French wrote in The New York Times on December 11 that under the Vacancies Reform Act, if a vacancy occurs in a Senate-confirmed position, the president "can temporarily replace that appointee (such as the FBI director) only with a person who has already received Senate confirmation or with a person who has served in a senior capacity in the agency for at least 90 days in the year before the resignation."

Until Patel’s confirmation goes through? I know that at least one of Wray’s seconds hadn’t planned on leaving yet, but this may change that. It’s not like a post they could leave empty.

The theory that this will create problems rests on the very flawed notion that Trump will be unable to get Patel through a nomination process and will thus want to recess appoint him. That's a load of hooey. Patel will be con firmed by the Senate, with many Dems voting for him as well. If anything, Wray's departure will create urgency to schedule Patel's hearings and vote, speeding up rather than slowing down the timeframe in which he will be seated.
