In 2019 two Montana women were detained by CFB for speaking Spanish. They sued and won. This is a copy of their lawsuit.

Among other things, the Customs and Border Patrol agents acknowledged that they wouldn't have stopped the women if they were speaking French. It was speaking Spanish that aroused the agents' suspicions.

So there is a basis for the rumors of people being detained just for speaking Spanish. It's happened before.

but there was a report of an incident involving the same women a couple years earlier, where the CBP didn't do anything because one of the agents said his wife knew one of the women.
