Idaho bans bumper nuts, topless beaches

This is the state's new indecent exposure statute:

18-4116. INDECENT EXPOSURE. (1) Every person is guilty of a misdemeanor if the person who willfully and lewdly, either:

10 (1) (a) Exposes his or her genitals,; exposes developed female breasts, including the areola and nipple; exposes adult male breasts, including the areola and nipple, that have been medically or hormonally altered to appear like developing or developed female breasts; exposes artificial breasts, including the areola and nipple, intended to resemble female breasts; or displays toys or products intended to resemble male or female genitals in any public place, or in any place where there is present another person or persons who are offended thereby; or

18 (2) (b) Procures, counsels, or assists any person so to expose his or her genitals,; to expose developed female breasts, including the areola and nipple; to expose adult male breasts, including the areola and nipple, that have been medically or hormonally altered to appear like developing or developed female breasts; to expose artificial breasts, including the areola and nipple, intended to resemble female breasts; or to display toys or products intended to resemble male or female genitals where there is present another person or persons who are offended thereby is guilty of a misdemeanor.

Can't say how they'll enforce it, but afaik, topless beaches typically don't involve anyone exposing anything "lewdly".

If it comes to court, a lawyer could certainly argue that the law specifically includes that word to make it clear that non-lewd exposure is not a being banned.

If it's not done willfully, it's not a misdemeanor. Full stop,
If it's not done lewdly, it's not a misdemeanor. Full stop.

That's 100% unambiguous from the construction if the sentence.

The word "lewdly" itself is subject to interpretation, but there's doubt that it applies. There would have to get a separate provision or a "notwithstanding the foregoing" part in order to override the earlier restriction that it has to be willfully and lewdly.

any reasonably competent attorney should be able to argue that the statute doesn't apply to really anyone except flashers? People who are trying to shock and upset people with their nudity?

So toddlers that are 100% done with wearing their clothes, breastfeeding moms, people just sunbathing on the beach, wardrobe malfunctions, those people would be safe even if there was some deeply offended, overly pious, whack-a-doodle there calling down both the wrath of God, and the Idaho state legislature?

so in the end, they're not really banning being topless, they're banning certain actions and/or speech while topless.

trials may come down was she just walking or was she moving things suggestively.

I live near Coeur d’Alene and the beach at Coeur d’Alene Lake is a big tourist attraction. In Sandpoint the same is true for Lake Pend Oreille. You’re only surfing at either one with a wakeboat, but you can do other beach stuff.

A Nampa city councilor named Sebastian Griffin went to Canyon County Pride one year (apparently so he'd have something to harrumph about at the next city council meeting) and saw a topless woman there. He tried to get the police to make her cover up or leave, and the cops told him what she was doing was legal.

The Idaho legislative session lasts months when they could get everything necessary done in a week. So, once they pass the budget, the tax cut, the bill relaxing gun laws and the anti abortion bill they run out of anything to do and start writing bills like this.

driving your megamaga coal hauling truck on the "Beaches of Idaho" while flaunting your areolas and nipples?

Funny thing though, I was just talking to a friend the other day and mentioned that I was going to take 2 weeks off in order to drive from Tampa Fl to the topless beaches of Idaho but they only have 3.4 hours of summer and I couldn't figure out which month that might be in so......................scratch that bucket list itme.
