MaddowBlog-Trump-appointed prosecutor stoops lower with inquiry into Biden's pardons

Donald Trump has a bizarre theory about Joe Biden's pardons. Ed Martin, a hyper-partisan Trump-appointed prosecutor, is apparently taking it seriously.

A couple of weeks ago, in a middle-of-the-night missive published to his social media platform, Donald Trump wrote that he was unilaterally invalidating Joe Biden’s pardons for Jan. 6 committee members.

The assertion — without precedent in American history — was apparently based in part on the Republican’s belief that his Democratic predecessor suffered from mental deterioration to such a horrific degree that he wasn’t aware of his own policies and preferences.....

What we did not know until this week, however, is that a Trump-aligned prosecutor decided to take all of this rather seriously. The New York Times reported:

Ed Martin, the ardent Trump loyalist serving as interim U.S. attorney in Washington, is pursuing an inquiry into whether former President Joseph R. Biden Jr. was competent to pardon his family members and others during his final days in office. The inquiry, which includes previously unreported letters to Mr. Biden’s family and former White House staff members, uses the levers of federal law enforcement to try to harass Mr. Biden’s family and allies and undermine his decisions as president, while scoring political points with President Trump.


The Times’ report, which has not been independently verified by MSNBC or NBC News, added that the Republican lawyer has sent “provocative” correspondence to the former president’s aides and relatives, in addition to sending letters to some of the beneficiaries of Biden’s pardons. The efforts, the Times added, “highlight Mr. Martin’s hands-on approach and willingness to use one of the most important U.S. attorneys’ offices in the country to seek retribution against Mr. Trump’s perceived enemies.”....

Indeed, the former “Stop the Steal” organizer’s interest in Biden dovetails with a lengthy series of similar efforts launched by the Republican lawyer, who has no prosecutorial experience.

Martin’s “greatest hits” package features misguided fights with the dean of Georgetown University’s law school, Senate Minority Leader Chuck Schumer, Democratic Rep. Robert Garcia of California and Democratic Rep. Eugene Vindman of Virginia. During his brief tenure, Martin has also:

demoted multiple senior officials involved in Jan. 6 insurrection cases;

falsely described himself as one of the president’s lawyers;

weighed in on a civil case involving the White House, which had literally nothing to do with his office;

intervened in a dubious Environmental Protection Agency investigation;

made a dubious decision in the case involving Republican Rep. Cory Mills of Florida;

launched the wildly unnecessary “Operation Whirlwind”;

also launched the wildly unnecessary “Project 1512” initiative;

also launched a wildly unnecessary "election accountability" unit;

made a creepy public vow to wield his prosecutorial powers against those who get in Elon Musk’s way;

engaged in brazen conflict of interest in a Jan. 6 case, in which he effectively took both sides of a criminal case;

and kicked off a radically unnecessary investigation into Jack Smith and a law firm that gave the former special counsel pro bono legal services.


.....What’s more, The New York Times reported that Democrats on the Senate Judiciary Committee have asked the D.C. Bar’s disciplinary counsel to investigate Martin, arguing that the Trump-appointed Republican has “abused” his prosecutorial powers.

Trump has nevertheless nominated Martin to be the permanent U.S. attorney in the nation’s capital — one of the nation’s largest prosecutorial offices — though Democratic Sen. Adam Schiff of California this week placed a procedural hold on the nomination. Watch this space.

Pardons are the sole prerogative of the presidency per the Constitution and they can't be revoked, invalidated or questioned. Trump's pardons of some truly reprehensible characters, including the J6 insurrectionists, would be subject to the same scrutiny by a Democratic administration. Ford pardoned Nixon even though he hadn't been charged with a crime at the time, and though a lot of people were unhappy about it, nobody claimed the pardon was invalid or revocable.

I am a transaction lawyer and I have not had an in person closing in good number of years because now all documents (other than negotiable promissory note) are signed by DocuSign or other service. My son is a finance lawyer at one of the largest firms and they never do negotiable promissory notes and so all of his closings are electronically.

President Trump's controversial choice to be the top federal prosecutor in Washington, D.C., Ed Martin, faces an uncertain future, as a Senate Democrat plans to put an indefinite hold on his nomination.

Martin, a "Stop the Steal" advocate and former defense attorney who represented U.S. Capitol riot defendants, is Mr. Trump's nominee to be U.S. attorney for the District of Columbia, and Sen. Adam Schiff, a first-term Democrat from California, plans to hold his nomination amid a growing number of controversial statements and decisions by Martin.

The position is among the highest-profile and most powerful federal prosecutor positions in the U.S. Martin, who refers to himself as "Ed the Eagle," has been serving as acting U.S. attorney for D.C. since Inauguration Day.

Senators have the power to invoke a hold on a presidential nominee, a maneuver that can slow or stall consideration of a nominee for days or weeks. Precious Senate floor time is often needed to overcome holds on presidential nominees.

"For the past nine weeks, Ed Martin has consistently undermined the independence and abused the power of the US Attorney's office in DC, openly threatening and intimidating political opponents, dismissing charges against his own clients, firing public servants for their roles in legitimate investigations and using his office as a cudgel to chill dissent and free speech," Schiff said in a statement to CBS News.

NEW: Last fall, Ed Martin—Trump’s nominee for U.S. attorney in Washington, DC—presented an award to Jan. 6 defendant Tim Hale, who prosecutors described as a “Nazi sympathizer.”

Here’s a video of that moment, in which Martin calls Hale an “extraordinary man” and “extraordinary leader” of “those who have survived January 6.”

Given Ed Martin’s recent record as the interim U.S. attorney in Washington, D.C., it was difficult to imagine how he could become even more controversial. But a new Washington Post report makes matters worse for the hyper-partisan Trump loyalist and former “Stop the Steal” organizer.

Martin is now interim U.S. attorney for D.C. and Trump’s pick to serve full time in the role. But as a conservative activist and former Missouri Republican official, he appeared more than 150 times on [the Russian state television network RT] and Sputnik — networks funded and directed by the Russian government — as a guest commentator from August 2016 to April 2024, according to a search of their websites and the Internet Archive’s database of television broadcasts.


What makes a story like this so striking is that it’s really made up of three overlapping problems.

The first is that Martin agreed to appear more than 150 times on Russian propaganda outlets.

The second is what Martin said during those on-air appearances: The Republican lawyer apparently had a knack for offering commentary that aligned with Kremlin talking points, including telling one host that there was “no evidence” of a Russian military buildup on Ukraine’s borders the week before the Russian military crossed those borders and began a war in Ukraine.

But every bit as important, if not more so, is the third problem: As part of his presidential nomination to serve as the U.S. attorney in one of the nation’s most important prosecutorial offices, Martin was required to disclose these media appearances to the Senate Judiciary Committee — and according to the Post’s report, at least initially, he did not. For those unfamiliar with the Missouri Republican, Martin’s “greatest hits” package features misguided and unnecessary fights with the dean of Georgetown University’s law school, Senate Minority Leader Chuck Schumer, former President Joe Biden and Democratic Reps. In a piece for New York magazine, Elie Honig recently described the lawyer as Trump’s “dangerous and ridiculous prosecutor.” Martin seems to be going out of his way to prove his many critics right.
