First you find the votes, then you take the votes, as the saying goes. But for a minute, there was a genuinely uncertain situation happening on Capitol Hill, as a handful of Democrats who wanted to give a big gift to the crypto industry had to weigh that against one of the most obvious and insane grifts in presidential history.
Unfortunately, they opted for the big gift, while teeing up a fake stab at accountability for Trump that is designed to fail and give pro-crypto Democrats a convenient alibi.
As we reported on Monday, a bill called the GENIUS Act would set up a relatively weak regulatory framework for stablecoins, digital assets pegged to the U.S. dollar and used mostly to facilitate crypto trading. It was almost destined for success, as a significant number of crypto-friendly Democrats, boosted by campaign contributions from the industry, were all set to sign on. But then reports about Trumps family organization launching a stablecoin, and the United Arab Emirates using it in a $2 billion deal to purchase the digital currency exchange Binance started bubbling up. Suddenly, it seemed like terrible politics for Democrats to effectively rubber-stamp Trumps crypto corruption.
And so nine pro-crypto Democrats vowed to vote against cloture and maintain a filibuster, thus blocking the bill, without changes. Some assumed that asking to address concerns was just a pretext to kill the measure. Others thought that the crypto Dems were just searching for a fig leaf they could use to say that their concerns were addressed and the bill could go forward.

If Democrats were serious about ending crypto corruption, they could have made those provisions a condition of their votes on the GENIUS Act. Instead they got a worthless amendment and gave away their leverage.
Schumer 101, said one source with knowledge of the process.
The timing of the release of the End Crypto Corruption Act was always suspect, a Trojan horse for senators who want to pass a stablecoin bill.

(20,947 posts)Washington Senate Democrats are rebelling against a crypto regulation bill, putting the first-of-its-kind legislation in jeopardy ahead of a possible key vote on it later this week.
The bill, known as the GENIUS Act, would create a regulatory framework for stablecoins, a type of cryptocurrency tied to the value of an asset like the U.S. dollar. It advanced out of the Senate Banking Committee in March with bipartisan backing, but has since bled Democratic support amid concerns about President Trump and his family's business ventures involving cryptocurrency.
The bill passed through the committee weeks before the announcement earlier this month that an Abu Dhabi-backed firm will invest billions of dollars in a Trump family-linked crypto firm, World Liberty Financial. The deal involves the firm buying $2 billion worth of a stablecoin offered by World Liberty Financial, and using it to invest in crypto exchange Binance.
The news set off alarm bells for Democrats, who are now pushing for legislation that bans elected officials and their families from buying or selling crypto assets, including stablecoins.

The Senates GENIUS Act failed to pass a key procedural vote on Thursday, a stunning blow to the stablecoin bills chance of passage that may have further negative consequences for other crypto legislation pending on Capitol Hill.
Several pro-crypto Democrats voted against cloture on the bill, meaning they did not support formally ending debate on the legislation and advancing it towards a full vote. Democrats who voted against cloture today, who previously supported the GENIUS Act, include Ruben Gallego (D-AZ), Mark Warner (D-VA), Lisa Blunt Rochester (D-PA), Andy Kim (D-NJ), Kirsten Gillibrand (D-NY), and Angela Alsobrooks (D-MD). Alsobrooks and Gillibrand initially co-sponsored the bill.
"While we've made meaningful progress on the GENIUS Act, the work is not yet complete, and I simply cannot in good conscience ask my colleagues to vote for this legislation when the text isn't yet finished," Sen. Warner said in a statement following the failed vote.
Now, chances of passage for the GENIUS Act, which would establish a legal framework for issuing stablecoins in the United States, have slimmed significantly.
