I am on pins and needles now.
I do not trust the immigration people at the border.
I do not trust ICE as she goes through the airport to get from international arrivals to domestic departures.
I do not trust the police to protect her from these kidnappers
I do not trust the government to honor her green card.
I was nervous to death the Chinese government wouldn't let her out due to their at-will enforcement of their social credit system.
I am terrified the American government will destroy my family and not let her back in, protecting the country from a green card holding kindergarten teacher and master's degree student.
All because she isn't white, christian, or come from a country Agent Orange doesn't denounce daily.

An attorney can do nothing until the foreigner is legally admitted into the country.

(6,740 posts)Francis Walter and Pat McCarran hated Jews, the Chinese, and Communists in that order. Our immigration laws were designed to keep people out, make the process of immigration as cumbersome, time consuming, and expensive as possible, and the revisions under Reagan made even a speeding ticket subject to revocation and deportation.
If they are admitted, they have civil rights and a way to fight. At the border, they do not.
I was almost denied re-entry into the US from Nogales four times because I refused to answer personal questions like:
What did you do in Mexico? (None of your business)
Where do you live? (That way. . pointed towards Tucson)
How long were you in Mexico? (long enough to do what I needed to do)
I was told by an obnoxious CBP officer, well yelled at, that I will answer all their questions and "why is it Americans cause all our problems?"
They won't allow video or cameras at their checkpoints because they don't want video evidence of their abuses to be used against them.
CBP has all the power at the border. And under this asshole in the White House, they are even worse.

(3,093 posts)I can remember my family going to nogales as a day trip to buy liquor. You could bring back one bottle per person in the car, no matter their age. A baby could bring back a bottle of liquor.
There was never a problem going or coming. Not with people of any color. Mexicans came into the US every day to work and shop and then go home.
People of color will have their revenge on us when the hospitality industry goes under. When people lose their farms. When food shortages begin. When nursing homes have to close. When hospitals have to close beds. When construction companies can't meet their deadlines.
Wait until there are no more honest hardworking people and magats finally realize all the criminals are still here.

(6,740 posts)unaccountable CBP at the border whose decisions are final and not subject to appeal under the Walter-McCarran Act of 1950. They deny, there is no recourse. Denial of entry is instant deportation under the INA of 1950 (Walter-McCarran). This was passed over-riding Truman's veto in 1950 at the height of the Red Scare and McCarthyism as a xenophobic response to the "fear" that communists were in our sock drawers, freezers, and Little League teams.
2: This admin has adopted Andrew Jackson's "let's see the court enforce its decisions" philosophy and will thumb their nose at any court decision they don't like and don't agree with.

(3,146 posts)These are ugly times, but sometimes the sun shines through. May it shine for you and your spouse.
Keep a lawyer at-the-ready in case things go south. If they do go south, you will have a long and bitter battle ahead. With a decent lawyer, you will prevail at last. But the fight would be nerve wracking.
My prayer is that your wife arrives and her re-entry to the U.S. goes smoothly and you will be able to bring her home without incident -- the way things are supposed to happen in America.

(8,181 posts)Im from an immigrant family and it is a worrisome time. All here legally, but you just dont know what BS this administration will try. Some folks have decided not to travel until this administration is gone. Thats how you know you are living under a dictator, when you are gripped with fear about what they will do to you.

(8,630 posts)Even thought, I am a naturalized citizen and white (French/American) I worry about traveling abroad and coming back. I was harassed at the border many times when I was a visa and then green card holder. My wife is native born American.
Yet, we are considering using burner phones when we fly to Europe and back into the US to avoid having them prying into our actual phones.

(348 posts)My wife, now a naturalized citizen, brought her daughter, age 10, from her home country in Feb, they entered via EWR. We had gone through the process and obtained visa, so everything is legal.
Nonetheless, I was so worried CBP would pull some bullshit and try to deny entry. But that was before miller talked stupid into starting the nonsense they are doing now.
We'd like to file for her daughter's Certificate of Citizenship (she's supposed to obtain derivative citizenship because her mom is a citizen) but we're worried this may draw undue attention.
Now, I would be as worried as you are.
Best of luck.

(710 posts)Unlike my ex-girlfriend, her now adult, lazy daughter never followed-up to get citizenship. She continually lost her card and her mother would always pay to replace it. The last time, the fee for a lost card was $1,000 and my then girlfriend told me that it was the last time she would help her this way. I thought that it was foolish for her not to apply for citizenship and my then GF agreed. Now her daughter has to worry about being sent back to South Africa, which she left as a toddler, if confronted by ICE. She works as a waitress in a restaurant in a blue city, typical job location that ICE lurks for undocumented immigrants.
