Tina Peters asks Colorado appeals court to recognize Trump’s pardon, release her from prison

DENVER (AP) — Former Colorado elections clerk Tina Peters is asking the state appeals court to recognize President Donald Trump’s pardon of her state convictions as valid.

In a motion Tuesday, Peters’ lawyers said the Colorado appeals court no longer has jurisdiction over her case because of a Dec. 5 pardon issued by Trump. They also asked the court to release her from prison because of the pardon.

Peters, the former Mesa County, Colorado clerk, was convicted of state crimes there for orchestrating a data breach scheme driven by false claims about voting machine fraud in the 2020 presidential race. Trump’s pardon power does not extend to state crimes.

In the court filing, Peters’ lawyers argued that President George Washington issued pardons to people convicted of both state and federal crimes in the Whiskey Rebellion in 1795. They urged the state appeals court to issue a ruling quickly. The court is set to hear arguments from lawyers in Peters’ appeal of her conviction on Jan. 14.

doesn't make it so. And an election clerk should know better!

We have a county supervisor that is gonna find out that POTUS doesn't get to meddle in state criminal trials. He keeps finding ways to delay his trial. Last delay: Oh, I have to have a hernia repair. I figure when the delayed court date nears, he'll claim he needs a hysterectomy.

A few weeks ago, the White House’s efforts to help former Colorado county clerk Tina Peters reached a new level: Trump’s Federal Bureau of Prisons contacted the Colorado Department of Corrections, seeking to transfer Peters from a state prison to federal custody.

Evidently, the request was not well received. The Associated Press reported:

Colorado doesn’t plan to transfer from state prison to federal custody a former county clerk who has become a hero to election conspiracy theorists following a request from the Trump administration, state officials said Wednesday. The Colorado Department of Corrections said it is not seeking a transfer of Tina Peters, who was convicted last year of orchestrating a scheme in Mesa County to breach voting machine data driven by false claims of fraud in the 2020 election.


“Transferring an individual is an action initiated by the Colorado Department of Corrections, not an outside entity,” department spokesperson Alondra Gonzalez-Garcia told the AP.....

Despite the Republican’s apparent interest in her case, there’s effectively nothing he can do: This was a state official, charged with state crimes, by state prosecutors, in a state court, with a state jury, overseen by a state judge, which necessarily means neither the president nor his Justice Department can overturn Peters’ criminal conviction.

Trump apparently intends to keep trying anyway, though there’s no reason to believe he’ll succeed.

Meanwhile, a bipartisan group of Colorado's county clerks say Gov Polis (D) is betraying election workers with his silence on whether he'll free Peters.

For his part, Peters’ defense attorney recently told Steve Bannon that he’d like to see the president deploy U.S. military personnel to the Colorado prison where Peters is being held in order to free her. The lawyer did not appear to be kidding.

and otherwise berating/belittling/becoming abusive toward the judges in her case--even at sentencing, and now she thinks telling the state's highest court that they have no power over her (no jurisdiction). Maybe you might want to rethink your pro se strategy (representing herself), although her prior lawyer is just about as stupid.

Trump can demand that instead of being tried in the US Senate, that his trial be held in the municipal court of Meridian, Mississippi or Muskogee, Oklahoma.

“L’État, c’est moi.” There is precedent.
