I'm not in the mood to look it up but I presume he would be violating the Constitution, and some sort of legal action would quickly follow. Which might end up at the SC ... which surely would enforce the Constitu ... oh wait ...

( we're fucked? )

I hope someone else has a better answer.

Anything done in this session like gaveling out the House becomes moot on January 6th when the new Congress begins.

Johnson won’t be SOTH anymore - he’s just another elected rep until (if) he’s re-elected SOTH (he won’t be)

Ok, lets just say that the republican controlled house refuses to address the midterm election. They refuse to take the oath for all congress people duly elected in 2026. Because of this we have NO congress after Jan 19th, am i right? Then what? That's the part i'm very confused about.

Let's say every Republican refuses. Then the House would be 100% Democrats, they elect a speaker and go about their business. Every member of the House is up for reelection. Whatever Johnson says or does is irrelevant. If they hold their breath until Trump is named emperor of the universe, it doesn't matter.

I can find nothing about what happens if no election votes are counted. After Jan 20th there is no congress, so that's what i'm not seeing.)
