Bail denied for Kharon Davis after nine years in jail without trial

A Dothan man in jail awaiting trial since 2007 on a capital murder charge had his request for bail denied on Friday.

Houston County Circuit Court Judge Kevin Moulton heard arguments from the prosecution and defense lawyers for 31-year-old Kharon Davis before issuing his ruling.

Dustin Fowler, one of three lawyers representing Davis on his pending capital murder charge, asked the court to set bail, saying his client had been incarcerated for an extended amount of time.

Dothan police arrested Davis, along with two other men, on June 6, 2007, in the shooting death of Pete Reaves at his Rolling Hills apartment.

the absurdity of holding someone without bail for nine years is shocking. The state needs to make its case or release him.

His lawyers requested the trial moved back to gather more evidence. It was granted.

He requested permission to fire his lawyers. It was granted.

A trial date was going to be set this year. His lawyer said that was not enough time since he was new to the case. It was granted.

I think the defendant deserves every shot at a fair trial, and at the same time, if they are requsting delays, I'm not sure what you do.

The state is ready to make a case, the defendant is not. Do you force them to have a trial this year, then if the defendant loses, they can try to get a mistrial by claiming there was not enough time to prepare.
