Susan Hogarth is suing North Carolina over a ballot selfie the state says was illegal

How can taking a selfie get you accused of a misdemeanor? In March, Susan Hogarth voted in the North Carolina primary and took a selfie with her completed ballot. The following week, she got a letter from state election officials letting her know that she broke the law.
North Carolina is one of 14 states that bans ballot selfies. In that state the act is considered a misdemeanor but comes with the potential penalty of 120 days in jail and a fine.
Now, Susan Hogarth is fighting back. She just filed a lawsuit claiming the state violated her First Amendment rights. Hogarth and her attorney Daniel Ortner spoke to Scripps News on Wednesday about the case.
"It wasn't against the rules, it was against the law," Hogarth said. "And bad laws need to be broken by people who want to see them changed. I wasn't hurting anyone. I was just expressing my enthusiasm for my candidates and my political party. I also wanted to challenge the law because I know that it's wrong." "I wanted to call them out a little bit."

(5,782 posts)I did not see any reference to it. But, I bet it had something to do with it. Since the NC General Assembly is super red... I find this a bit suspicious.

What is the "need" to show people who you voted for?

(720 posts)So short of banning phones there is no way to ban cameras in the booth. Someone who actually sold their vote isnt going to broadcast it to the world so posting a photo of your ballot is highly unlikely to be evidence of a crime. Selfies are part of life for younger voters and this is going to keep happening.

(102,065 posts)But you haven't addressed the need you claim for the law to go. Buying votes is still a potential problem. If they sent the photo privately it'd be a problem, and if they do it publicly, it would be too. Doing something in public doesn't stop it being a crime. "Selfies are part of life" is not a reason for binning a law that has a purpose. This is not about selfies; it's about photographic evidence about how you voted, and that's not "part of life". "This is going to keep happening" is something you can say about all sorts of illegal activity, and is not a reason to bin a law.

There's nothing that supercedes the free advertising this creates for Ms. Hogarth.

Would you be comfortable with someone in a polling place taking pictures?
How about if the pictures were taken by self-described and self-appointed "poll watchers"?
The issue is not as cut and dried as some would make it seem.

(1,213 posts)Because all of you asshats who think everyone wants pictures of your every fart and butt scratch don't have the sense to keep OTHER VOTERS out of your vanity frame. You're not the only voter in a polling place, you know.

(51,120 posts)Imagine that a Republican was trying to buy votes - paying a voter $100, say, to vote for Trump. No one wants to pay someone $100 if they can't prove a vote for Trump was cast, so the bought voter takes a ballot selfie and texts it to the person trying to buy the vote.
