Federal judge rejects Donald Trump's request to intervene in wake of hush money conviction

NEW YORK (AP) — A federal judge on Tuesday swiftly rejected Donald Trump’s request to intervene in his New York hush money criminal case, spurning the former president’s attempt at an end-run around the state court where he was convicted and is set to be sentenced in two weeks.

U.S. District Judge Alvin Hellerstein’s ruling — just hours after Trump’s lawyers asked him to weigh the move — upends the Republican presidential nominee’s plan to move the case to federal court so that he could seek to have his conviction overturned in the wake of the U.S. Supreme Court’s presidential immunity ruling.

Hellerstein, echoing his denial of Trump’s pretrial bid to move the case, said the defense failed to meet the high burden of proof for changing jurisdiction and that Trump’s conviction for falsifying business records involved his personal life, not official actions that the Supreme Court ruled are immune from prosecution.

In a four-page ruling, Hellerstein wrote that nothing about the high court’s July 1 ruling affected his previous conclusion that hush money payments at issue in Trump’s case “were private, unofficial acts, outside the bounds of executive authority.”

NEW YORK (AP) -- A federal judge on Tuesday rejected Donald Trump's request to intervene in his New York hush money criminal case, thwarting the former president's latest bid to overturn his felony conviction and delay his sentencing.

U.S. District Judge Alvin Hellerstein ruled that Trump had not satisfied the burden of proof required for a federal court to take control of the case from the state court where it was tried.

Hellerstein's ruling came hours after Manhattan prosecutors raised objections to Trump 's effort to delay post-trial decisions in the case while he sought to have the federal court step in.

The Manhattan district attorney's office argued in a letter to the judge presiding over the case in state court that he had no legal obligation to hold off on post-trial decisions and wait for Hellerstein to rule.

Some will cry out "Double standard" in sentencing - But, unfortunately, it won't be MAGA - their minds will not be changed by a harsher, more fair sentence.

there is a near unanimous sentiment that there would be no prison time. And then the appeal cycle will commence once more.

The federal cases on the other hand, would definitely have stronger support for prison time, particularly with that NY state criminal case having become an "aggravating factor" for sentencing.

This motion was so frivolous that it did not deserve or get a hearing. This is the second time that TFG has tried to remove this case to federal court.

May the "sentencing report" please leak! I want so bad to read it -- now! I simply can't imagine just what "mitigating" factors there may be which would balance against a unanimous jury verdict convicting that criminal Turd of 34 Felony crimes each involving criminal Fraud and Deceit. "If you land on “Go To Jail,” whether you rolled doubles or not, you are sent immediately to jail and your turn ends." That's the way that it is, criminal Turd. Your "turn" is so over!
