Texas sues to block Biden rule protecting privacy for women who get abortions

Sept 5 (Reuters) - Texas sued the Biden administration in an effort to block a new rule that seeks to protect the privacy of women living in states that ban abortion who travel out of state for the procedure.

In a lawsuit filed on Wednesday in Lubbock, Texas, the state is asking a federal judge to strike down the rule, which prohibits healthcare providers and insurers from giving state law enforcement authorities information about reproductive healthcare that is legal where it was provided.

President Joe Biden, a Democrat, said in announcing the rule in April that no one should have their medical records "used against them, their doctor, or their loved one just because they sought or received lawful reproductive health care."

The measure came in response to efforts by authorities in some Republican-led states that ban abortion, including Texas, to restrict out-of-state travel for abortion. So far, no criminal prosecutions or civil judgments have resulted from those efforts.

On a stick! Texas’ government has lost its goddamned collective mind.

That’s private medical information, which the state has no right to see (except, perhaps in certain exigent circumstances like mandatory, reportable diseases). Talk about a HIPAA violation.

Texas is also asking the court to block a separate rule issued in 2000, which said healthcare providers and insurers can only hand over information if it is relevant to a legitimate law enforcement inquiry and is limited in scope.

Texas said in its lawsuit that providers frequently cite the 2000 rule as a reason for not responding to subpoenas from state investigators, and have begun invoking the new rule as well.


No State has any legal authority to share medical records with anyone but the patient, and no State has any way to "force" another State to provide any such information. No healthcare provider or insurer is going to provide health care information to anyone but the patient. There is no gray area here.

The State of Texas is plain and simply pretending it can obtain this information as long as they just "ask for it correctly" or something and that they need no justification for getting it. They are essentially saying its unfair that The State of Texas would need a "legitimate law enforcement inquiry" to obtain private medical records. Its beyond insanity that a State is essentially claiming ownership of individuals and a right to their medical records for any purpose they desire(which is the logical extension of rejecting that they need a legitimate law enforcement inquiry.)

If and and big IF TFG wins, expect red caps inspecting cars, buses, trains, and planes to test for pregnant women, and force them to stay in state for 9 months until the blessed one is born, and into the streets with the worthless bugger. Don't come back until you want to serve as cannon fodder or cheap labor for the 1%

“They” know a blue wave is coming. Women, the men that love ‘em, family, and friends are
going to turn out in a crushing blue wave this fall. Violating a woman’s right to privacy, hipaa
laws, and jamming their Christo Fascist bullshit down other people’s throats is a good way to
piss people off and lose elections. Every State that has had women’s health care rights on
the ballot since Roe v Wade was struck down has seen the vote go to a woman’s right to choose.

FAFO is coming to get these right wing assholes big time this fall. And Btw you don’t think little
Ms. Blond Cheerleader who lives in a McMansion in a Dallas suburb where people talk about being
