Missouri judge rules against abortion amendment; group to appeal ruling

COLE COUNTY, Mo. —
Late Friday, a judge from Cole County Circuit Court ruled that the Missouri abortion amendment was flawed and should not have been approved for the Nov. 5 ballot.

Judge Christopher K. Limbaugh also decided not to remove it from the ballot but allowed the matter to be reviewed by an appeals court.

"Having found that defendant-intervenors failed to comply with 116.050.2(2) RSMo, the court must conclude that the defendant-intervenors' initiative petition was insufficient," Limbaugh wrote in his ruling. "The court now looks to the relief it must provide under these unique circumstances."

Limbaugh later wrote that the "unique issues involved" and the "lack of direct precedent" prevented him from ordering the amendment off the ballot immediately.

7. Intentionally broad?

Plaintiffs' attorney Mary Catherine Martin on Friday argued that the campaign to restore abortion rights in Missouri drafted an amendment that is intentionally broad in order to trick voters into supporting it.

I was curious about what was meant by "intentionally broad," so I googled to find out what the actual wording is. Here's a link to a pdf of the text of the proposed amendment.

My take? Yes, it's broad, but it has to be, because "reproductive freedom" covers a lot of territory. I suspect the forced birthers are uncomfortable with the idea of these matters being discussed in any way that does not include a misleadingly gruesome and lurid forced birther-approved description of abortion.

I guess defining "reproductive freedom" in a manner that sounds sane and reasonable to most people is what "pro lifers" consider "tricking voters"!
