Trump picks Rep. Matt Gaetz as attorney general

President-elect Donald Trump on Wednesday said he will nominate Republican Rep. Matt Gaetz of Florida to serve as U.S. attorney general. Trump wrote on Truth Social that Gaetz has distinguished himself in Congress through his focus on achieving desperately needed reform at the Department of Justice. Gaetz replied on X, It will be an honor to serve as President Trumps Attorney General!
If he is confirmed by the Senate, Gaetz will succeed Attorney General Merrick Garland, who led the Justice Department as it carried out a sex-trafficking investigation into the congressman. The DOJ ultimately declined to charge Gaetz.
Gaetz remains the subject of an ongoing House Ethics Committee investigation into whether he engaged in sexual misconduct or illicit drug use. Gaetz, who has denied any wrongdoing, said in September that he would no longer voluntarily participate in that panels probe.
The 42-year-old lawmaker, who has carved out a reputation as a staunch and vocal Trump loyalist, has aggressively criticized the DOJ investigation and prosecution of Trump by special counsel Jack Smith.

Ambassador almost 20 years ago (2005), and that would take him out of the House, but would only be in effect for the Congressional session.

Gaetz isn't all that popular in the House. I don't see how he gains enough support in the Senate

The whole point of it was that in the past, Congress pretty much did recess/adjourn before the end of a calendar year "for the holidays" and other circumstances might also come up where there was a need/desire to get someone into the position when the chambers were not in session (imagine the horse and buggy days). But this is why the position was considered "temporary" and only in effect until the end of a session".
We went through this rigamarole under Obama when he attempted to Recess Appoint some NLRB members while they were doing "Pro-forma" (gavel in/out every 3 days) sessions, Obama was sued, it went to the SCOTUS, and Obama lost (and the appointees were removed).

(27,698 posts)Neither House can adjourn for more than three days without the consent of the other - which means a concurrent resolution... which is subject to filibuster. Democrats don't have to allow it.
But again... I don't see it as necessary, because the nomination doesn't have to hang around - there should be enough "no" votes (one republican has already said as much) long before there would be a recess

(142,213 posts)You might have also missed all the bloviating from 45 "demanding" that the Senate do recess appointments. And with the GOP taking control of the Senate come January, they can put any old set of Rules in place as long as they have a "simple majority" to pass them and they can coordinate that with Johnson to restrict the "Pro-forma" sessions when they feel like it (and again, coordinate with the House, who could pass their own parallel set of Rules to stipulate to the coordination).

(142,213 posts)Based on the cited section of Article I Sect. 5 of the Constitution, BOTH chambers are considered recessed if they are not in session for more than 3 days and if they plan on that happening, they need to "coordinate" that.
This wasn't normally an issue because by and large, they weren't in as combative of times in previous years until after the Gingrich takeover and stolen election of 2000.
So when after Shrub "recess-appointed Bolton" (see this - https://www.nbcnews.com/id/wbna8758621 and also this as a good discussion about the issue via an interview - https://www.npr.org/2005/08/02/4781459/the-expanding-power-of-a-recess-appointment), Democrats lit the place up. And per that last linked article, Republicans had been similarly pissed when Clinton had done similar when he was in office.
So both parties made a decision to do away with the ability for a President to go around the Senate for confirmations - notably to address the controversial ones who would probably never make it out of Committee, and they did this by "NEVER" going into a "Recess". Even during the winter holidays - you can flip on CSPAN during one of those days of Christmas/New Year's week and see both Chambers "in session", with Clerks there and some other staff and an assigned "Pro-tempore" in the Senate and House to run the show.
I.e., they set up a Rule in their respective Chambers, to literally have someone (normally who lived close by like in MD or VA), to come into their respective Chamber, literally "gavel in" for "Normal Business" (or "Morning Business" ), that includes the Pledge of Allegiance and Convocation, etc., and then maybe have some 1-minute speeches if anyone was around wanting to do that, and perhaps read off the upcoming schedule and submit some written remarks for the record, and then they would RECESS "SUBJECT TO THE CALL OF THE CHAIR" - meaning in 3 days, they would do it all again. Come in, gavel in, Wash. Rinse. Repeat.
These were what they called "Pro-Forma" sessions.
What Obama did was object to the Pro-Forma because literally, once they recessed subject to the call of the chair, nothing was really getting done and he argued it was a literal "recess". So he ignored THE RULES (that were voted on by each Chamber for their Chamber), and appointed people to the NLRB. The GOP sued, it went to the SCOTUS, and SCOTUS basically said - "If those are the Rules of the Senate, then THOSE ARE THE RULES. The Executive Branch has no authority over how the Legislative Branch chooses to conduct business".
THE END.
Now remember - those are RULES and at the beginning of each Congressional session, each Chamber drafts and votes on NEW Rules (in most cases, keeping most of the previous session's Rules and tweaking them or adding/subtracting from them).
The GOP does NOT yet control the Senate, so this will NOT happen now. That will only happen in January when the NEW 119th Session gavels in and they draft NEW Rules, and THAT is when they can coordinate with the House to adopt Rules that would allow an actual "Recess" (by each Chamber), allowing 45 to put in whoever they want "temporarily". I.e., they are only in that position for that Congressional session (not "permanent" ).
All you have to do is be a CSPAN junkie and you will see this wild stuff in action!!!!

(142,213 posts)and it is something that won't be decided until the 119th Congress is sworn in January 3, 2025, when they have their formal leadership elections and they start drafting their "Rules".
But if both chambers of Congress decide to go "full loon", they may just allow them to thwart any Democratic member blocks. The Senate still has a couple GOP "institutionalists" in there, so they may balk and kill it or perhaps allow it only if there are caveats and stipulations for such.

From another thread: I think this gets Gaetz out of the House and thus out from under the ethics probe (taking the new majority off the spot of having to deal with him). It also allows some senators to show some independence from the incoming administration by signaling their opposition
and then Trumps eventual AG seems moderate by comparison.
The only question becomes Gaetzs consolation prize

Theres no need for a nominee to resign instantaneously. Im more and more convinced that this has nothing to do with the AG slot
except to make the eventual pick seem more reasonable by comparison

There is precedent in Congress on the Senate side for an ethics committee report to become public after a member resigns from Congress, however. In 2011, this happened when Sen. John Ensign of Nevada resigned amid allegations that he tried to hide an extramarital affair.
But it's not clear that that would apply to the House, leaving open the possibility that the report on Gaetz would not be released.
