Judge orders DOJ to respond to Trump co-defendants' arguments about Smith report

U.S. District Judge Aileen Cannon is ordering the Justice Department to respond to arguments made by President-elect Donald Trump's former co-defendants in his classified documents case by 10 a.m. Sunday.

Cannon, who earlier this week temporarily blocked the report's release, wants the government to address whether anything in the first volume of special counsel Jack Smith's report, which deals with Smith's Jan 6 investigation, bears on any aspect of Trump's co-defendants in the classified documents case.

The judge's order immediately followed a filing from DOJ that repeatedly argued she had no further jurisdiction to continue to weigh in on the release of the first volume of Smith’s final report after the department successfully appealed her initial injunction overnight to the Eleventh Circuit Court of Appeals.

The other motions -- including Trump's co-defendants' motion to extend Cannon's halt of the report's public release -- have not yet been ruled upon.

A caller to Thom Hartmann's show suggested that Biden should immediately pardon Trump operatives Nauta and DeOliveira, who are the criminal co-defendants whose right to a fair trial Aileen Cannon is supposedly protecting.

Nothing is lost by doing so, since Trump will make the case go away anyway as soon as he takes office.

With the threat of prosecution eliminated with a pardon, Volume 2 of the special prosecutor's report (i.e. treason at Mar-a-Lago) can immediately be published.

Would the court filings not already identify any possible overlap? Indeed, would not this information already be disclosed during Discovery? Plus, these 2 defendants are not named in the J6 case so why this bizarre demand of the Special Counsel, who has resigned following the earlier 11th Circuit ruling. Indeed, isn't this case already in the hands of the DA for the Southern District of Florida? I can make no sense of this, including where she has standing at this point to make this request.

Kind of like Bruce Doucette. If you ask her she probably won't answer since she probably thinks only a sheriff can ask her questions, but she probably thinks she is a Superior Court Judge of the Continental United States of America. To know what that mean you would of course have to be a sheriff and get access to Bruce Doucette who is currently serving 38 years in Colorado for 34 counts of racketeering, tax evasion, retaliation against judges, and filing of fraudulent liens.
