DOJ to appeal judge's decision to block Fed subpoenas in Powell criminal probe

A federal judge in a scathing ruling blocked subpoenas issued by a grand jury to the Federal Reserve as part of a criminal investigation of Chair Jerome Powell. U.S. Attorney for the District of Columbia Jeanine Pirro immediately said that the Department of Justice would appeal what she called the “outrageous” ruling, after it was unsealed Friday.

Friday’s action will likely keep Powell in the chairman’s seat longer because Sen. Thom Tillis, R-N.C., has vowed to block Kevin Warsh’s confirmation to succeed Powell until the federal investigation ends. That may mean interest rates remain higher than President Donald Trump wants for longer because Powell has refused to bend to the president’s demands to lower them further.

Boasberg, in his ruling, said evidence showed Pirro was motivated to investigate Powell because of a desire to get the Fed chief to bow to Trump and cut interest rates quickly and broadly. Pirro’s investigation purportedly is focused on the Fed’s multi-billion-dollar renovation of its headquarters in Washington and on Powell’s testimony to the Senate Banking Committee about that project.

“Did prosecutors issue those subpoenas for a proper purpose? The Court finds that they did not,” Boasberg wrote in the decision in U.S. District Court in D.C., which was dated Wednesday, but unsealed on Friday. “There is abundant evidence that the subpoenas’ dominant (if not sole) purpose is to harass and pressure Powell either to yield to the President or to resign and make way for a Fed Chair who will,” the judge wrote.

A federal judge has quashed subpoenas the Justice Department had issued against Federal Reserve Chair Jerome Powell, according to court documents unsealed Friday.

The ruling is a major blow to President Donald Trump, who has repeatedly criticized Powell for not lowering interest rates and urged the Justice Department to investigate the outgoing chair.

US District Judge James “Jeb” Boasberg wrote in the new opinion that a “mountain of evidence suggests that the Government served these subpoenas on the Board to pressure its Chair into voting for lower interest rates or resigning.”

“On the other side of the scale, the Government has produced essentially zero evidence to suspect Chair Powell of a crime; indeed, its justifications are so thin and unsubstantiated that the Court can only conclude that they are pretextual,” Boasberg said.

"Will no one rid me of this meddlesome priest?"

Probably English history since he went to Oxford.

But Trump knows very little of English history or Church history.

and has been trying hard, since last year, to sanction this administration, going back to the illegal flights of immigrants to CECOT against his orders. The 4th Circuit Appeals Court keeps throwing up barriers but he is still working on it.

A federal judge blocked the Justice Department’s move to subpoena Federal Reserve records, a significant setback in its inquiry into central bank chief Jerome H. Powell and his testimony about the Fed’s renovations of its headquarters.

Chief U.S. District Judge James E. Boasberg in D.C. quashed a pair of subpoenas tied to the investigation and ordered the docket in the case unsealed after attorneys for the Fed and U.S. Attorney Jeanine Pirro’s office battled over the legality of the probe in a closed-door hearing this month.

The judge’s ruling, dated Wednesday and unsealed Friday, criticized the Justice Department’s efforts to investigate several of President Donald Trump’s perceived political foes since last year and said the Powell inquiry was the latest instance of weaponizing law enforcement for political ends.

“A mountain of evidence suggests that the Government served these subpoenas on the Board to pressure its Chair into voting for lower interest rates or resigning,” Boasberg wrote in the opinion. “On the other side of the scale, the Government has produced essentially zero evidence to suspect Chair Powell of a crime; indeed, its justifications are so thin and unsubstantiated that the Court can only conclude that they are pretextual.”.....

Tillis and several other Republicans on the Banking Committee — including the panel’s Republican chairman — have said they don’t believe Powell committed a crime in his June testimony, which briefly touched on the office renovations.



.....In a readout of a previously unreported Jan. 29 meeting with Pirro, Powell’s personal attorney said the chair “would not leave the board when his term as chair expires if he was still under investigation.”

The pushback to the investigation was swift, broad and bipartisan, with several congressional Republicans agreeing that it was a mistake to pursue the Fed chair with trumped-up charges.

Late Friday, the case, such as it was, unraveled. MS NOW reported:

In a remarkable decision, Chief Judge James E. Boasberg of the U.S. District Court for the District of Columbia wrote that ‘a mountain of evidence’ suggested that ‘the Government served these subpoenas on the [Federal Reserve] Board to pressure its Chair into voting for lower interest rates or resigning.’ Boasberg added that federal prosecutors ‘produced essentially zero evidence to suspect Chair Powell of a crime,’ calling the Trump administration’s case ‘so thin and unsubstantiated that the Court can only conclude that they are pretextual.’


....Broadly speaking, there are a few elements to consider as the dust settles on the ruling and the White House weighs its future options.

First, the president really ought to be asking himself right now whether it was a smart move to tap a former Fox News host to serve as the top federal prosecutor in the nation’s capital. Jeanine Pirro’s failed effort against Powell was humiliating, but it coincided with a similarly humiliating effort to indict Democratic veterans in Congress who advised service members to follow the law, which coincided with a separate failed criminal investigation into Joe Biden.

In fact, Pirro’s office has lost so many closely watched cases with such regularity that it’s been challenging to keep up with them.

Second, in an unusual press conference following the apparent demise of her case against Powell, the Republican prosecutor made little effort to claim she had evidence of wrongdoing, but said she wanted to go after the Fed chair anyway, just in case some undetermined crimes might have been committed......

As the press conference started to wrap up, Pirro was asked about the frequency of federal grand juries rejecting her efforts. Her furious response offered fresh evidence that she’s ill-suited for the position she’s in.

Finally, there’s the road ahead. Given the circumstances, there’s a silver lining for the White House to the rejection of the baseless case against Powell: The sooner this case goes away, the easier it will be for Senate Republicans to move forward with Kevin Warsh’s nomination to succeed Powell. All Pirro had to do was accept Friday’s outcome, scrap plans for an appeal and move on to other priorities.

The prosecutor instead signaled plans for the opposite path, which dovetailed with the president publishing a hysterical tirade to his social media platform, condemning Boasberg and accusing Powell of wrongdoing in the vaguest ways possible.
