Proposition 140 will stay on ballot, votes will be counted, Arizona Supreme Court rules

Count the ballots, the state Supreme Court ruled Friday, allowing a measure creating open primary elections to be decided by Arizona voters.

The court's unanimous ruling caps an epic effort to get the Make Elections Fair Arizona Act before voters. On the ballot as Proposition 140, the measure would create a primary system in which all candidates compete and all voters are eligible to cast ballots — similar to the way many municipal elections are held.

In a brief order, Chief Justice Ann A. Timmer wrote the court rejected a request to issue an injunction barring election officials from counting the votes cast for or against Proposition 140.

The justices affirmed the decision of Maricopa County Superior Court Judge Frank Moskowitz that efforts to disqualify the measure came too late, given ballots were sent to the printer beginning Aug. 23. The court also accepted Moskowitz' finding that it is unconstitutional to count invalid signatures twice.
