Court dismisses part of lawsuit holding college liable for Rock, Paper, Scissors rape at fraternity party
A New Jersey college and its officials are not liable in the case of a former student who was raped at a fraternity party, after the victim said two students played rock, paper, scissors to decide who would assault her first, the U.S. 3rd Circuit Court of Appeals said in a ruling published Monday.
The woman, who appears in documents under the pseudonym Jane Jones to protect her privacy, was 19 at the time of the attack in 2014 at Ramapo College. She said she was served drinks by a fraternity pledge known as C.L." until she was completely inebriated at a frat party. C.L and another man played a game of Rock, Paper, Scissors" and C.L. sexually assaulted Jones.
Other fraternity members became aware of the sexual assault and threw C.L and Jones out of the apartment. C.L then drove Jones past Ramapo security checkpoints to a freshman dorm. At the dorm, two residents, Christopher Rainone and Justin Sommers, let C.L. and Jones enter the building and followed them to a room.
Jones was once again sexually assaulted by C.L. and another man. Rainone, Sommers, and a fifth student, Jordyn Massood, watched and videotaped the attack, the court document states.
