The owner of a Brick asphalt and concrete maintenance company will spend a year in prison for skipping out on more than $435,000 in employment taxes.
Donato DiPasquale, 57, of Brick will also have to serve three years of supervised release and pay back the Internal Revenue Service for failing to pay taxes from 2010 to 2015.
The owner of Stars-N-Stripes Asphalt Maintenance, DiPasquale was in charge of collecting and paying payroll taxes for his employees. He was also responsible for filing with the IRS Form 941 which showed the payroll taxes the business withheld and paid to the IRS each year.
Todays sentencing is a reflection of just how serious the courts view these crimes and Mr. DiPasquale is now a convicted felon with a prison term to serve, said Michael Montanez, Special Agent in Charge of the IRS Criminal Investigation Newark office in a statement.
