Order Middletown to pay us $1.7M, Suez asks federal judge

Suez North America is asking a federal judge to order the imposition of an arbitration ruling that will require Middletown Borough to pay it nearly $1.8 million in an ongoing dispute over the lease of the town’s water and sewer systems.

Also, that arbitration decision calls for Suez to be allowed to charge the systems’ customers for extensive line replacements to be done over the 50-year life of that lease.

If U.S. Middle District Chief Judge Christopher C. Conner confirms the arbitration award it will mark another major defeat in a string of losses for the borough in its battle to amend the lease deal.

That agreement, approved by borough officials in September 2014, required Suez to pay Middletown $43 million up from and another $45 million over the life of the lease.
