HB 1128 Pro-"Wife Beater" Bill Holstered by TNGA Rep. Timothy Hill
TNGA Rep. Timothy Hill (R-3, Blountville) quietly withdrew his pro- "wife beater" HB 1128 legislation on Monday, February 25, 2013. The Hill HB 1128 legislation would have compelled Tennessee courts to establish ""clear and convincing evidence" before assigning order of protection issues to a party within a domestic partnership, a legal standard much higher that the "a preponderance of the evidence" legal threshold currently utilized by Tennessee state courts:
SECTION 1. Tennessee Code Annotated, Section 36-3-605(b), is amended by deleting
the language "a preponderance of the evidence" wherever it appears and by substituting
instead the language "clear and convincing evidence"...
