In 2000, the Tennessee Supreme Court ruled in Planned Parenthood v. Sundquist that the Tennessee Constitution contained a stronger right to privacy and abortion than even the U.S. Supreme Court Roe v. Wade decision.
Passage of the 2014 Tennessee Constitution Amendment will modify the state constitution thus allowing the legislature to enact whatever regulations and restrictions may be permitted in the future by the United States Supreme Court,
The proposed Tennessee Constitution Amendment 1 reads as:
"Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion. The people retain the right through their elected state representatives and state senators to enact, amend, or repeal statutes regarding abortion, including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother. "
