Washington State Supreme Court quashes Jim Walsh's lawsuit to hide the costs of his destructive initiatives from voters

Washington State Republican Party Chair Jim Walsh’s legal challenge to an NPI-championed law that requires fiscal disclosures on ballots for initiatives with financial impacts has been tossed by the state Supreme Court, in another victory for fair elections and transparency. As a consequence, three statements alerting voters to the costs of Initiatives 2109, 2117, and 2124, all sponsored by Walsh and funded by multimillionaire donor Brian Heywood, will appear on millions of voters’ ballots this autumn like they’re supposed to.

In his capacity as a state legislator, Walsh opposed and voted against the law, which was a top legislative priority of ours in the 2022 short session two years ago.

The law was adopted over Republicans’ objections, and it went into effect several weeks later. Its existence is believed by many Democratic and progressive strategists to have played a role in convincing Republican donors not to fund a 2022 statewide ballot measure seeking to force a statewide vote on whether to keep or repeal the capital gains tax on the wealthy that’s helping fund the Education Legacy Trust.

Though Walsh has known of the law’s existence the whole time, he and Heywood have inexplicably been operating as if it didn’t exist. Repealing the capital gains tax is really important to both of them, so they chose to make a measure that would do that part of their slate. But now, having collected the signatures and forced the vote (which will take the form of Initiative 2109), they have come face to face with the reality that there is a law that requires voters to be alerted of initiatives with fiscal impacts.
