The decision of the United States Circuit court for the district of Minnesota in the case of the government against the Northern Securities company was affirmed by the United States Supreme court March 14, 1904. The opinion was read by Justice Harlan, Justices Brown, Brewer, McKenna and Day concurring. Chief Justice Fuller and Justices White, Peckham and Holmes dissented. In effect the decision of the lower court was that the "merger" of the Great Northern and Northern Pacific railroad properties through the formation of a company holding the securities of both companies was in violation of the Sherman antitrust law of 1890 because the combination of the roads would result in the restraint of interstate commerce. This contention was fully upheld by Justice Harlan.
