TOMS RIVER, N.J. (AP) — New Jersey officials are defending proposed building rules designed to limit damage from future storms and steadily rising seas in coastal areas, countering criticism that the state aims to force people away from the Jersey Shore by making it harder and more expensive to build or rebuild there.

Lawmakers from both parties held a hearing Thursday in Toms River, one of the hardest-hit communities by Superstorm Sandy, to discuss the state’s Protecting Against Climate Threats initiative and respond to criticism of the proposal from business interests.

Mandated by an 2020 executive order from Democratic Gov. Phil Murphy, the proposed rules are designed to account for rising seas and a changing climate in making land use decisions near the ocean, bays and rivers in an effort to limit damage from future storms.

The rules would extend the jurisdiction of flood control measures further inland, require buildings to be constructed five feet (1.5 meters) higher off the ground than current rules call for, and require elevating roadways in flood-prone areas.

People should be “free” to do whatever they want. First off, let’s repeal all zoning laws. Next, let’s repeal all speed limits. Oh, and seatbelt laws. Next, I demand that under the 2nd amendment, I have a right to own fully automatic weapons. …

You understand of course that when the next “Superstorm” hits, I will expect the emergency crews to rescue my family from the floodwaters, without consideration of their own lives.

TRENTON, N.J. (AP) — New Jersey’s ban on the AR-15 rifle is unconstitutional, but the state’s cap on magazines over 10 rounds passes constitutional muster, a federal judge said Tuesday.

U.S. District Judge Peter Sheridan’s 69-page opinion says he was compelled to rule as he did because of the Supreme Court’s rulings in firearms cases, particularly the 2022 Bruen decision that expanded gun rights.

Sheridan’s ruling left both 2nd Amendment advocates and the state attorney general planning appeals. The judge temporarily delayed the order for 30 days.

Pointing to the high court’s precedents, Sheridan suggested Congress and the president could do more to curb gun-related violence nationwide.

The judge doesn’t agree with the Supreme Court’s rulings, but…

Fine let people build where ever they like. They pay the full cost of insurance (if any company will write it) or fully fund any rebuild as well as pro-rate cost of utility/infrastructure access/service to the property.

Most of the homes are empty vacation rentals, out of town owners.

They expect the government to build revetments and come every January to push the sand off the street, FEMA pays to rebuild their home smashed by waves and wave carried debris.

The Commission and Local Coastal Plan are looking at one-time-rebuild rules, giving notice that you don't get to live on the edge of danger in perpetuity and we aren't going to keep bailing you out.

Life sucks when you have decided to buy an income property where nature gets its way and climate change is sending strong messages to move on, to retreat.
