How The Hell Did This Happen? Supreme Court Refuses Challenge To Biden Rule On Coal Ash Disposal

The Supreme Court has declined to halt a Biden administration rule that seeks to prevent legacy toxic waste from now-shuttered coal plants from leaking out and contaminating nearby groundwater.

In a brief order, the high court said it would deny an emergency request from the East Kentucky Power Cooperative to temporarily block the rule from taking effect while underlying litigation against it plays out. The Supreme Court did not offer an explanation for its rejection of the power cooperative’s petition. No dissents were noted.

The court’s move does not necessarily mean that the Supreme Court’s justices believe the rule is permissible; it just means they are not ready to block it at this stage — before lower courts hear challenges to it.

Ed. - Oh, THAT'S how it happened!!

The rule in question applies to waste that’s also known as “coal ash” — which contains dangerous substances like mercury and arsenic. It requires coal plants that closed before October 19, 2015, to take steps to prevent coal ash from leaking out of “ponds” where it is stored.

...the supreme court is letting this rule stand for now so that it can be somehow used against any Democratic actions associated with it.

It's how the nazi's roll.

It is truly stunning how any decent, sensible, and caring human could be against the Biden rule.

To be against it is to be in favor of, or at very least not caring if, toxic waste from closed coal plants leaks into and contaminates groundwater with mercury and arsenic thus requiring mitigation if possible and detected in time to prevent human contamination which is unlikely.

It is hard to believe that the citizens of Kentucky would be on the side of the power company but given it is an action from the dread Democrats then I guess anything is possible in order to 'give it to the libs'.

It hurts my head trying to comprehend this situation.
