(10,440 posts)Statutory rape is statutory rape. the girl is over 18 and the other girl is a minor. equality means it is the same for either way or one way. Now, if it ends up a stricter charge than normal for the same thing, then bitch about it. but sex with underage people is a crime.

(13,609 posts)the article says they started dating at 15 and 17 respectively. Just after her 18th birthday they had her arrested. It doesn't say they were together when she was 18. I would suspect so, but it gives the impression that it was the birthday the parents were waiting for. I would think there would be some legal reason to fight instead of taking a plea. Just waiting for the birthday without some reasonable warning of intent may be an offense in itself. But I'm no lawyer.
In the big picture, the whole thing is idiotic.

Both of these girls are in the same high school. They began dating when both were underage. They are within a few years of age. I dont know how often a HS boy dating a HS girl get charges, if one has hit that 18 yo mark but is still in school. Im guessing its not all that often, but maybe Im wrong. I do know there were a plethora of hs frosh dating seniors and college frosh when I was in school. I resented it a bit, as it drastically reduced the pool of mutually interested parties available for my adolescent hormones to seek connections with.
Then again, I wonder about the practical side of it. How do you prove "sexual battery", between two females? With a guy, there may be a condom, or fluids, etc. Seems harder to actually prove, though maybe easier to convince a jury, depending on the attitudes of the area.

(17,045 posts)...is that this arrest is not in the spirit of the law and that the law itself is faulty. Their position actually has little to do with the fact that it was a same sex relationship, except that they believe that the parents of the younger girl only pressed charges because of the same sex aspect, which is highly likely.

A reminder is that this family is not asking for charges to be dropped. They are asking for the charges to fit the crime. As it stands, Kate is charged with two felonies and has been offered a felony child abuse.
It is important to note that Kaitlyn's family even begged for mercy, telling them they would move Kaitlyn out of state if they had to.
What's smacks of crap to me is that she is a supposed "child molester" but the judge ordered she could remain in school. The board expelled her (except they're allowing her to walk at graduation).
