The Oath Keepers -- the armed, anti-government vigilante group known for popping up at the Ferguson protests and elsewhere -- has told Kim Davis' legal counsel that they would be willing to "protect" the anti-gay marriage Kentucky clerk from being detained by the U.S. Marshals Service. According to Right Wing Watch, Oath Keepers founder Stewart Rhodes has said he is already on his way to Kentucky.
In a statement posted to the Oath Keepers' website, Rhodes claims that the federal judge who ordered Davis' detention after she refused to issue gay marriage licenses "grossly overstepped his bounds and violated Mrs Davis due process rights, and in particular her right to a jury trial."
Prior to Davis' release from detention Tuesday, the Oath Keepers planned to picket the home of the judge, U.S. District Judge David Bunning, Right Wing Watch reported. It is unclear if she will be detained again if she gets in the way of her clerks' office issuing the licenses, as her lawyers have suggested, when she returns to work.
"We must stand against this. And so we will protect her and prevent it from happening again," Rhodes said in the statement.

(30,058 posts)Her duties or resign. I am beginning to think the oath keepers has too much time on their hands. It would be interesting to determine how many in their is on some type of disability and if so disable to hold a job but can run out to "protect" someone from doing their job then it is time to make them requalify for their disability status.

However, the TPM headline is misleading and this really isn't a gun rights story. The Oath Keepers' actual statement, while often vile and simply wrong as a matter of law, does not reference the Second Amendment, nor actually directly threatens anyone with violence, including U.S. Marshals, firearm or otherwise. The First Amendment guarantees their right to spew their ideology and peacefully mostly protest where and how they choose (including carrying firearms where otherwise permitted by law, although the gun issue was not raised by the group in connection with, nor is it part of, the Kim Davis story).

Oath Keepers and Kim Davis offer more than ample reasons for disgust and discussion. There's simply no need for TPM to add any embellishments.
This story is certainly newsworthy, but belongs in LBN or GD.

(4,462 posts)If so, I imagine the answer would be no. Most state and local matters are handled at the country level, and citizens must use Office of the Country Clerk in the county where they reside. Kim Davis is the duly elected (Democratic ) clerk for Rowan County, and cannot normally be bypassed or removed without extreme difficulty, as is evident from recent news stories.
If the state tried to close all relevant county offices in Rowan, an unlikely and possibly unlawful act, it would harm all the innocent citizens of the country, including stopping everything from marriage licenses to recording mortgages.

(6,719 posts)Our dept of motor vehicles offices are always moving around -- closing and opening -- constant change. I have to look on the internet whenever I need to go to a DMV office. But it is a big county so there is always one available somewhere. Just wondering if there was a way to isolate her.

(4,462 posts)However, since she's an elected official, the situation is a mess that's not easily resolved, particularly without making Davis a political martyr and encouraging similar action across the country. The national political spotlight related to the election primaries is unfortunately making a very bad situation much worse.
In my opinion, the best thing that could happen is expedited appeals until the matter reaches the Supreme Court. As an attorney, I'm confident that a unanimous (or very close to it) court would side against her. The conservatives on the court might by ideological at times, but as a legal matter, Davis' actions are really inexcusable. Her remedy if she objected to issuing the marriage licenses should have been simply to resign in protest. I believe a SC decision including the conservatives would drastically diminish her support, and she would finally be forced to comply with the law or resign.
