2013 Colorado Guns Laws Might Be Back In Court After Ruling

The 10th Circuit Court of Appeals on Tuesday threw out a 2014 federal court ruling that upheld new Colorado gun laws.

Tuesday's ruling means sheriffs who oppose the ban on high-capacity magazines and private sale background checks expect to be back in court soon.

And they plan to take advantage of that second chance, according to one of their attorneys -- David Kopel with the Independence Institute.

"The constitution is the same today as the day we filed the case, and we intend to vindicate the constitution and remove these unconstitutional stains from on Colorado’s statute books," Kopel said.

In an odd twist, the appeals court threw out the decision that upheld the gun laws because the sheriffs and others lacked standing to bring the case.

theater that doesn't actually do anything. While background checks are a good idea in principle, they don't affect criminal sources or use.

And the article doesn't really provide any. Sounds like Colorado has a ban on high capacity magazines (what is "high capacity&quot and that background checks are required for private sales? And was that law previously thrown out by a federal court? Who pays for and performs the background checks for private sales?

aimed squarely at gun enthusiasts and competitive shooters, which are abundant in Colorado. Statewide law enforcement vehemently opposed the capacity limit, which was passed by Bloomberg's people over LE objections, and most sheriff's departments have flatly refused to enforce it. That piece of idiocy ended Hickenlooper's hope of ever being a viable presidential candidate, which is a shame.

There was a bipartisan effort last year to at least raise the limit to 30 rounds, but a fundy lobbyist with NAGR or somesuch killed it.
