SLOATSBURG - One day before William Groesbeck III shot his wife to death and then killed himself in their home, Ramapo police gave him back the handgun he used in the shooting, according to a lawsuit.
The wrongful death lawsuit alleges Ramapo police should have never given the gun back to Groesbeck, a retired New Jersey police officer, because he did not have a state license for the pistol. It had been confiscated by police months earlier after a domestic dispute between Groesbeck and his wife, Patricia Nigro, at their 3 Adam Court home.
Nigros daughter from an earlier marriage, Diana Santaiti, filed the lawsuit on April 28 in state Supreme Court in New City against the Town of Ramapo, its police department, and Groesbeck's son, Jamie, who is identified as the executor of Groesbeck's estate.

But Stern, the lawyer representing Ramapo, said the the town will argue Groesbeck qualified to have a gun under a federal law that entitles former law enforcement officers to possess their service weapons, and exempts them from registering for a pistol permit.

Gilbert said Ramapo police gave back a weapon to which he had no right. He didnt have a license.
Paul Piperato, Rockland County Clerk, confirmed that Groesbeck did not have a pistol license registered with either the state or county.
The town and police department had not yet filed their response in court to the lawsuit. Ramsey Police Chief Bryan Gurney said Groesbeck retired from the Ramsey police department around 1983. He said it wasnt clear under what terms Groesbeck left the force.
