A pastor in an affluent suburb of Portland may have run afoul of Oregon law when he transferred an AR-15 assault rifle that he won in a softball league raffle to a gun-owning friend for safekeeping without performing a background check...
...Lucas, of Christ Church Episcopal Parish in Lake Oswego, a suburban town about 10 miles south of Portland, drew national attention recently when he used $3,000 in discretionary church funds to buy as many of the raffle tickets as he could for a softball league fundraiser to send high school students to a regional tournament in California.
Lucas, 44, wanted to win so he could destroy the gun. He told the AP on Tuesday that he has received overwhelming support from parishioners...
...Last year, state lawmakers passed a new law that made transferring a gun without a background check illegal, even if the arrangement is between two private parties and no money changes hands. If Lucas were to be convicted of a misdemeanor charge of unlawful transfer of a weapon, he could face a maximum fine of $6,250 and up to a year in jail.
Congratulations, Reverend Lucas- you've joined a select fellowship:

(21,000 posts)you though a law that applies to "all transfers" meant "ALL" transfers.
No it only applies to racist yahoo gun owners who are stockpiling an arsenal. It was never meant to apply to people acquiring guns to destroy them. We know they are good people. Or people who own gun but would be willing to turn them in if asked, they're good too. And gun control advocates; they need guns to protect themselves from gun owners so no laws for them either. And celebrities. And rich folks, obviously...
We can also trust this "friend" that the Pastor transferred the gun to. We know he's ok because he is trusted by a Pastor who wants to destroy guns.

(18,577 posts)When Ray Rice beat his wife unconscious in an elevator, New Jersey Superior Court Judge Michael Donio and New Jersey District Attorney Jim McClain agreed to put him in a diversion program for 1st-time offenders to keep him out of jail. But when Pennsylvania single mom Shaneen Allen was pulled over for a traffic violation and volunteered to a New Jersey police officer that she was carrying a legally-owned handgun with a Pennsylvania permit, the response of Donis and McClain was to deny her the same opportunity as Rice.
Allen lives in Philadelphia, right across the river from New Jersey. She has a Pennsylvania permit to carry a handgun. She thought it was recognized in New Jersey, just as it is recognized in over 30 other states. She was wrong. When she told the officer that she had the gun, she was arrested.
Now she faces a felony conviction and a mandatory 42 months in prison. Both Donio and McClain have been unwilling to dismiss the charges, or send Allen to a pretrial diversion program. They seem to want to make an example of her.
A couple of weeks ago, I wrote about Shaneen Allen, a single mother from Philadelphia who was arrested for driving through New Jersey with a handgun. Allen had a permit for her gun in Pennsylvania, but New Jersey doesnt recognize Pennsylvania gun permits. Despite the fact that Allen volunteered that she was in possession of the gun during her traffic stop, she was still arrested and charged with a felony. According to her attorney, she is eligible for a diversion program for first-time offenders that would avoid a felony conviction and mandatory 42 months in prison. But for reasons he has yet to articulate, New Jersey District Attorney Jim McClain has refused to allow her to take advantage of that program.
Last I heard Ms. Allen had been diverted to pretrial program but during her stay in jail she almost lost a job and custody of her children.

(470 posts)about the Shaneen Allen case was that the Nra donated to her defense fund. the only thing i can figure is they thought she was white.
The case made a minor celebrity of Allen, a 28-year-old black single mother who legally bought a handgun in Philadelphia but was arrested after unwittingly violating New Jerseys strict gun laws. Similar to how tough drug laws designed for taking down kingpins ended up being used against low-level offenders, harsh gun laws can ensnare people like Allen, who are merely trying to protect themselves.

To which your colleague replied:
What alternative universe do these people live in? Oh, I forgot. Liburty and freedumb land. Only in the NRA's mind can this reasoning make sense.
In your own words, should the "not law abiding" Rev. Lucas be prosecuted or not?

When the owner asked to see his FOID card (Firearm Owner ID) required for any gun or ammo purchase, Father "Phlaky" Pfleger told the crowd (Mob) to "Drag him out and snuff him out".
Pfleger denied it of course, but it was all on the store's video tape.
Just another typical "peaceful" gun control supporter.
