Nevada lawmaker seeks gun rights for legal marijuana users
A North Las Vegas Democrat has introduced a bill in the Nevada Senate that would allow medical marijuana users to possess a firearm and obtain a carry permit.

As part of a bevy of legislation in the state Senate addressing medical marijuana reform introduced this session, one measure would help to preserve the gun rights of those with a cannabis card.

Sponsored by state Sen. Kelvin Atkinson, his bill would update Nevada law with the respect that the holder of a valid medical marijuana registry card would not be deemed to be an “unlawful user of, or addicted to,” a controlled substance solely based on having a card. Current state law bars firearm possession by those so classified and requires a sheriff to automatically deny applications for concealed carry permits to the more than 15,000 residents with a registered medical marijuana card. Under Atkinson’s proposal, this would change.

Just because a person uses marijuana, this does not mean they are intoxicated 24/7. However, as was noted elsewhere, federal law still considers all users as illegal drug users. This needs to be fixed too.

It's Federal law that prevents medical marijuana users from purchasing a gun.

At BEST, it MIGHT allow a Nevada resident to buy a gun through a private sale.

I have mixed feelings about this. I support the legalization of marijuana, but also oppose people using or carrying firearms while impaired and some one who is high on pot is impaired.

Would make it state-legal to buy a gun, but still illegal under federal law. Have to change the fed before actual possession becomes fully legal. I also have a problem with the impaired part, as how do you readily test like you do with alcohol? Will there be a "legal limit percentage"?

Nevada is just saying 'for those folks who want to break the law, the feds will have to get you and pay for your arrest, trial and time in prison and, since this is stupid, we're not helping'.

if they have any reason to believe that you are a medical marijuana user.

It would not surprise me in the slightest if the Federal government has accessed the databases in the various states that have medical marijuana.

in Montana but Montana can't overrule the Federal law against it. It's a pointless exercise.

Sen. Kelvin Atkinson should go to Washington and make a stink about the ridiculous state of federal drug laws. But that would be real work.
