Iowa Gov. Kim Reynolds signs law allowing permitless handgun carry, purchase

Iowa Gov. Kim Reynolds has signed a law allowing people to buy and carry handguns in Iowa without a permit, fulfilling a longtime goal of gun rights advocates.

The law, which some advocates call "constitutional carry," will take effect July 1.

"Today I signed legislation that protects the 2nd Amendment rights of Iowa’s law-abiding citizens while still preventing the sale of firearms to criminals and other dangerous individuals," Reynolds, a Republican, said in a statement after signing the measure Friday afternoon.

Democrats and gun violence prevention groups say the law will roll back background checks on handgun sales between private citizens. That's because, under current law, Iowans must pass a background check to obtain a permit to carry or acquire a handgun before they can legally buy one in a private sale.

Per the law: It would become a Class D felony to sell, rent or loan a gun to a person that the seller "knows or reasonably should know" is prohibited from owning firearms. That crime would be punishable by up to five years in prison.

People legally prohibited from owning firearms are those convicted of felonies, domestic abuse, etc.

But what she said was criminals and other dangerous individuals. I’m just wondering what would classify someone as an “other dangerous individual” if no crime was involved.

Adults that are still the wards of other people because of this handicap. Dementia, Alzheimers, brain damage, etc. I'm not an expert on this but I know you can remove a person't autonomy if they have issues like that. My mom had to do that for her parents a couple of years before her father died.

Executorship? Something like that.


Also probably people you know are not born or naturalized US citizens. I don't know when an immigrant can own a gun, but I imagine some of the levels of being in the US legally don't allow it.

I'm not saying they're dangerous, but if you're not sure if that guy on the H-1B visa can own a gun, you shouldn't sell him one.

The Gun Control Act (GCA), codified at 18 U.S.C. § 922(g), makes it unlawful for certain categories of persons to ship, transport, receive, or possess firearms or ammunition, to include any person:

convicted in any court of a crime punishable by imprisonment for a term exceeding one year;

who is a fugitive from justice;

who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act, codified at 21 U.S.C. § 802);

who has been adjudicated as a mental defective or has been committed to any mental institution;

who is an illegal alien;

who has been discharged from the Armed Forces under dishonorable conditions;

who has renounced his or her United States citizenship;

who is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner; or

who has been convicted of a misdemeanor crime of domestic violence.

The GCA at 18 U.S.C. § 922(n) also makes it unlawful for any person under indictment for a crime punishable by imprisonment for a term exceeding one year to ship, transport, or receive firearms or ammunition.

Further, the GCA at 18 U.S.C. § 922(d) makes it unlawful to sell or otherwise dispose of firearms or ammunition to any person who is prohibited from shipping, transporting, receiving, or possessing firearms or ammunition.
