All I know is that she didn't sign the letter. That doesn't mean that she voted against it. There may not even have been a vote; just individuals deciding whether or not to sign.

His speech is protected there. They can't go after him.


Alternatively, he could pull a Mike Gravel, and insert the material into the Congressional Record.

Maybe Harry Reid will do it. I agree, someone needs to do it.

Can they release classified information? Maybe he feels that it's more proper to allow the President to do it. If he is able to, he could always do so if Obama won't.

Ackerman is certainly correct that the Speech or Debate Clause immunizes members of Congress from prosecution for disclosing classified information on the floor or in committee hearings. See Gravel v. U.S., 408 U.S. 606 (1972). As he also recognizes, however, members are not protected against congressional discipline, up to and including expulsion, for revealing classified information without permission.

If this is correct he couldn't be prosecuted but he could still face consequences.

First, it would require a 2/3 vote to expel a Senator. The Republicans would get nowhere near that. Plus the political costs to them for trying to expel someone who revealed that Russia interfered with our election are probably something they wouldn't want to incur.

Obama doesn't seem disposed to take any action regarding election interference. He should have reined Comey in back in July, but nope.

They can do so without legal consequences if they do it properly. Going to Obama first may simply have been a matter of trying to do it the more "acceptable" way first before using the protection of the Senate floor to release the information.
