The Big Con should be arrested...

Donald J. Trump should be investigated, formally charged and indicted for treason if this turns out to be true. His connections to Vladimir Putin and the FSB should be given a serious look by Congress with the same vigor displayed by Trey Gowdy when his committee investigated Hillary Clinton on Benghazi. Which, in fact, found absolutely nothing that could be considered criminal by any court in this country.

Call the Senate Ethics Committee at 202-224-2981 ask them to investigate Herr Gropenfuhrer until the investigation is complete! You can leave a message on their voicemail.

The definition of treason: 18 U.S. Code § 2381 - Treason: Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the U.S. penal code. ~Patrick

Per the Constitutional n, that or a confession is the only way to convict.

That said, it our Constitution Law Profesor in Chief isn't claiming there's a case here, I'm not getting worked up about this.

Congress can't impeach him because of the backlash from the teabags.
Their only way out is to have the CIA/FBI charge him with treason and hang him.

She says, "of course he doesn't want to meet with the CIA; they have his number." She believes Trump conspired with the Russians and the CIA knows all about it.

Seems plausible to me. There is no rational reason to refuse intelligence briefings. It makes him negligent in any terrorist attack. Something isn't right there.

•NATO and Russia have profound and persistent disagreements; however, the Alliance does not seek confrontation and poses no threat to Russia.

Doesn't sound like NATO has declared or even considers Russia an "enemy".

We have many disagreements with Russia (as we do with many other countries to varying degrees), but that doesn't make them an "enemy" as a legal matter.

Courts looking at the concept of "treason" would not give enemy a broader reading than it is given elsewhere in law (and might give it a narrower reading).

Thus, for example, the courts likely would take into consideration the definition found in title 50 of the US Code (War and National Defense): Section 2204: "the term "enemy" means any country, government, group, or person that has been engaged in hostilities, whether or not lawfully authorized, with the United States."

The term "hostilities" is not defined in title 50, but it is defined in title 10 (Armed Forces). Section 948a - "The term “hostilities” means any conflict subject to the laws of war."

Our differences with Russia do not amount to a conflict subject to the laws of war.

As I've pointed out several times, treason is a very narrowly defined, very infrequently prosecuted offense. Among those not prosecuted for treason: the Rosenbergs (convicted, arguably unfairly, of espionage), John Walker Lindh, Aldrich Ames, Robert Hanssen, Edward Snowden....the list is actually quite long.

There is absolutely no chance that Trump will be prosecuted for "treason" nor would there be any chance of him being convicted if such a prosecution was brought. Crimes may have been committed by the Russians and its even possible that Trump was in some way complicit, but even that wouldn't mean he would or could be charged with or convicted of treason.

have immunity from prosecution. The only recourse then would be impeachment and conviction by a Republican controlled Congress, which is very unlikely.
