CHICAGO (WLS) - Mayor Emanuel is explaining why he'll appeal yesterday's ruling by a judge tossing last year's charges against Occupy Chicago protesters for violating the Grant Park curfew.

The judge ruled against the city because the police used the Grant Park curfew against the Occupy protesters but didn't use it against the thousands of people who came to the park to celebrate Barack Obama's election in 2008.

Apples and oranges, says the mayor. Here's how he argues Barack Obama's supporters were in the park legally and the occupy protesters weren't.
