There is no law against having or making any sort of list - that's a First Amendment right of free speech. It is circumstantial evidence maybe in a trial, he has a Fourth/Fourteenth Amendment right to "Due Process" and a "presumption of innocence". We still have Bill of Right here.

Due Process Clauses are found in the Fifth and Fourteenth Amendments to the United States Constitution.
