My theory why the indictment of James Comey has been resurrected: [View all]

DOJ via Trump claim that the sharing of a "cool" photo that Comey took on the beach that had someone else's shells spell out "86 47" is to be used to counter Trump's 1/6 "speech" to the MAGA crowd.

IOW, if Comey's case is dismissed (as it will be) as constitutional First Amendment free speech, then Trump will claim that his social post stating that the 1/6/24 "will be wild" and his speech on 1/6/24 ("If you don't fight like hell, you're not going to have a country anymore" ) is just as legal and not subject to accountability. (The January 6th Committee argued this message acted as a "battle cry" that energized followers to travel to Washington D.C.)

In sum, if Comey's seashell photo didn't threaten Trump's life or inspire stochastic terrorism, then Trump's January 6th verbiage should be held to the same standard.

I know, I know. Trump's MO is logical fallacy, particularly false equivalence.
