In reply to the discussion: Ohh That's Rich - birthright citizenship 6-3 to 5-4 ruling explained [View all]DemocracyForever
(425 posts)48. Kavanaugh is wrong
Through the 14th amendment, the constitution grants citizenship to ALL people who are born here. This is NOT a statute! This is the constitution itself. No Congressional law can change that. Only a constitutional amendment can change it. Kavanaugh wrongly implied that not everyone's citizenship is guaranteed by the constitution. This is clearly false. Kavanaugh also falsely claimed that a Congressional law could change it and that's totally wrong. That's what I've been saying from the beginning. I will never back down from defending what's actually in the constitution.

I never said reconsider the case. An actual law could be rightly challenged and reach the Supreme Court.

This is still just an opinion and one that doesn't carry the force of law if the Supreme Court decides otherwise.

As I explained, there are two sources of citizenship: the constitution and statute.
