Because the article seemed somewhat confusing.

The options for these guys are:

1. Remain in jail for life if plea bargain is accepted

2. Go to trial which would result in either:

A. Death Penalty if found guilty (likely)

B. Mistrial due to their treatment (torture) while in Guantanamo which could lead to their release? (possibly)

C. Release if found innocent (unlikely)
