2. they are using the investigation to posture politically

"We reiterate that ActBlue has been, and intends to be, transparent and cooperative with any
legitimate Committee investigation. But we believe that it is imperative that the Committees
provide more information concerning the stated intent to collaborate with a purported Department
of Justice investigation. The Department of Justice has its own investigative tools, and it cannot
properly outsource them to the Committees, consistent with the separation of powers under our
Constitution."

"If the Committees are now working to gather information on behalf of Department of
Justice prosecutors, rather than for legitimate legislative purposes, that would fundamentally
transform the nature of your investigation—and violate ActBlue’s constitutional rights. The
Constitution and other federal laws provide Americans with procedural protections to ensure that
criminal investigations are conducted with fairness, integrity, and with the appropriate
confidentiality to protect the rights of those who have not been charged with any crime. If this
investigation now serves a law enforcement effort by the Executive Branch, then those protections
must be honored."

If DoJ already is in the process of preparing a case then Congress' investigative powers become more limited, especially if they are acting as a partner of DoJ.
