Indiana attorney general sues sheriff over immigration enforcement [View all]

SOUTH BEND, Ind. (WISH) — Indiana Attorney General Todd Rokita has filed a lawsuit against the St. Joseph County sheriff.

During a press conference at the St. Joseph County Courthouse on Friday afternoon, Rokita said the suit claims the sheriff does not notify U.S. Immigration and Customs Enforcement (ICE) prior to releasing illegal immigrants.

The lawsuit also says the sheriff does not honor ICE requests to hold an illegal immigrant until agents can take custody of the person.

Rokita says the sheriff ignored requests nine times over six months, and another four times after Rokita first inquired about the practice.

The Republican attorney general said Friday, “Indiana law says that you can’t have any policies that restrict communication between local law enforcement and federal law enforcement. The lawsuit maintains that they, in fact, are, and they either have policies or practices that do that. Secondly, you can’t limit or restrict your polices/practices or local ordinance to anything less than the federal law allows, and we believe that they may be doing that as well.”
