Of course the drive is going to claim they didn't see it and thought they hit a pothole. Being a politician it will be downgraded to the lower offense with the driver compensating the cyclist financially. It often takes two mistakes to make a accident, prime example Bike ran the light and didn't look, the car wasn't keeping a good eye on the road.
