They are not saying he definitely flew in a helicopter and saw the traffic jam. They are saying they are investigating whether or not he did, because there's evidence he and Wildstein were together at least one day during the traffic jam and he took the helicopter back. This means it is a possibility and worth checking out. If it does prove true, he's as good as gone.
