Chris Wray's Resignation Sets Up Legal Hurdle for Kash Patel's FBI Bid

By resigning, rather than waiting for Trump to fire him, Wray is setting up a legal obstacle to Patel's immediate installation as FBI director.

Author David French wrote in The New York Times on December 11 that under the Vacancies Reform Act, if a vacancy occurs in a Senate-confirmed position, the president "can temporarily replace that appointee (such as the FBI director) only with a person who has already received Senate confirmation or with a person who has served in a senior capacity in the agency for at least 90 days in the year before the resignation."
