When her agency was specifically ordered to turn the plane around, and she stated to some extent "my agency will not do that," it is defying a federal order.
First amendment right doesn't actually apply to the government outside of preventing it from stopping individuals from speaking -which is what this action, and the recent kidnappings of individuals appears aimed to do.
And for individuals like Noem, in judicial cases, your words can absolutely be used against you, something called "Intent" to commit a crime. Contempt of court is a crime. She openly stated she will ignore a judge's orders and was doing so in her power. That's generally a common sense conclusion.
