It comes down to which party holds the majorities in the two houses of Congress. However, in fairness, I will add that there does not seem to be a better alternative.

Also, as far as elections are concerned, it used to be the unwritten rule that presidential election results were not to be challenged. JFK asked Nixon to meet with him following the 1960 election. JFK wanted to know if Nixon planned on challenging the vote count in Northern Illinois. Of course, historians have speculated that an Illinois recount could have cut either way. The downstate Republican edge might not have held up so well.
